You can't force them. Facebook and twitter has been known to change companies minds before though. Slag them off, loudly

Ahh. Except I am not on either of those. Starting one now wouldn't give me enough followers for my voice to be considered worthwhile. Not to mention time is against me. I'm considering calling them to ask them to reconsider or offer to pay a third of their charged. Any thoughts???

It's not about your followers. Their followers will see it and thus you hope they become embarrassed.

Phoning to settle is an option and can work.

M1, I didn't call them. Really silly of me. But now I've got a letter through the post that is most likely a court summons. It's return address is POB 300, Northampton NN1 2TX. I'm actually scared to open it because I just cannot see myself going to court. We're in the middle of a move and it's just the worst time ever with a baby under 6months. I tried calling them (yes, a case of closing the gate after letting the horse out) but they were shut. My options are really limited now but I'm hoping that this is a scare tactic and they would still accept my offer to pay a percentage of their so called costs???!
          :faint:

I'm pretty sure that's a court claim. You have to open it. If you don't they'll get a default judgement and you'll have £165 to pay (or whatever it is they are claiming).

Although you need to take action now if you take it to court it'll be several months away.

              Hi M1
i missed your reply. Ended up in the wrong folder. I opened the letter after my initial scare. It was a letter saying that judgement had been made in favour of claimant. I rolled my eyes at it and huffed and puffed because they never sent a letter informing me of the case being sent to court, the name of the court or the case date. The letter was not written on official letterhead (although they did try to make it appear to be an official letter). The fee they are asking for is now £195 or thereabouts.

I've ve just moved house so it's really been difficult to get to the bottom of this, although I was able to spare a few moments in between nappy changes and unpacking to call them. The agent on the phone put me on hold for a good deal of the call and then informed me that I would have to send them an email for them to consider my offer to pay £20. Apparently she doesn't deal with the legal side of things but she did inform me that as the 7 day deadline to pay the fee for the county court claim had elapsed they have put my account in default (hence the higher fee now).

It's all scare tactics and it's worked so far. I haven't had the chance to send them an email yet but I also haven't heard from them.

I keep praying it all goes away!!!

I'd phone the court to find out if judgement has been entered. If it has and you don't pay within 28 days of judgement you'll have a CCJ on file for 6 years.

                  Hi M1,
thanks for your post. PE actually did judge against me and i now have a ccj. I called the court and they confirmed it. I haven't got much options left as it is. I can't speak directly to the enforcement team at PE and I don't have any confidence in them responding to my emails in a timely fashion. I only have a week left before it's too late for the ccj to be removed. The court said I can contest or challenge the ruling but that would cost me over 90% of what the actual charge is (now £182). I previously had outstanding credit and it's not worth my credit score being messed up for six years so I will have to pay up! It hurts I tell ya but hopefully it would be the first and the last time PE get any money from me!

Sometimes you just have to accept how it is. A set aside, whilst possible in certain circumstances, is costly and there is no guarantee you'd win.
