  • Parking Eye Court Claim - Pls help!

    Hi I parked in Morrissons Car park in February. I overstayed by about 45mins. Received letters from PE, which I ignored (I thought the advice was still the same). I then received a court claim from moneyclaimsuk on behalf of PE for £160. I just had a baby and was in fact making my first solo trip with my three small children the day I parked at Morrissons. I would like to defend the claim. Can anyone help?

    I've gone on the website to do the AOS but there's a part I am not sure about. It asks if I wish to contest jurisdiction of the claim made against me. I'm not entirely sure what this means. This is all very new to me so please be patient.

    Any help provided would be much appreciated.

    Jurisdiction is fine, do not contest it.

    What are the particulars of claim ?

    Have you asked Morrisons about cancellation ? (they are pretty poor) Get on facebook and twitter though and use the new mum angle prominently. These companies hate that kind of publicity.

    Pictures of the signs and any letters you have will also help.

      thanks for getting back to me. I'm currently away from home so it's a bit difficult getting pictures of the signage. But I've asked my other half to go to the parking lot and take pictures of the signage and to attempt approaching the manager of the Morrissons.

      I was so confident about the way this would pan out that I've carelessly misplaced the actual letters. Does this mean I don't stand a chance? I'm hoping not. I've asked my other half to also try and locate them. But I've completed the AOS and would continue to research how I can write a good defence, which is where I would need your help.

      I knew I was running over the 2hr limit but I had a small emergency - my 3 yr old wanted to use the loo and I needed to pick up a few items for lunch. By the time I had packed my bunch into the car and drove off, I had overstayed by about 40 minutes (I believe the letter said 42mins to be exact). It's unreasonable to now be asked to pay £160.

      Once I've figured out how to upload pics on this, I would upload scanned copies of the court claim. These are the only documents I currently have. I'm hoping that you would still be able to help.

          Hi M1, thanks again for your speedy response. I've attached a copy of the claim form. I've also asked my other half to have a word with the manager of Morrissons and to take the letter with him too. I would let you know what the outcome is. Please let me know where I go from here.

            First thing to do is to log on to the MCoL site and file acknowledgement of service which should be done asap. This gives you until 14/6/14 to file a defence.

            When hubby speaks to Morrisons make him take pictures of the signs.

              I filed the AOS a few days ago. Thanks for giving me the date to send in my defence. I wasn't sure. I'll send those pics once I've got them.

                My husband spoke to the manager of Morrissons and he agreed to contact PE to cancel the ticket. I'm very pleased.

                    Looks like you were right. PE have written me requesting I pay costs associated with the county court claim. Have a look at the letter I've attached. They say I've only got 7 days to pay up, but I'm not sure when the 7 days is from, the date marked on the letter or when I received it. Please help!!

                      I wouldn't worry about the date. If you want to pay they'll take your money. If you don't it doesn't matter.

                        No, I definitely don't want to pay or feel it's fair to pay! I just can't believe how desperate they are. So I just ignore this and that's it?

                          If that's your choice, yes. They'll probably proceed to court.

                          Take the letter to Morries and see how they react.

                            Further reading and info to provide the court. Interesting comment by the judge. Hope it's a mistake as the prankster points out or it shows huge bias.

                              No joy at Morries. Said I took too long to respond and they've now gone to court and there's nothing they at Morries can do to help (effectively repeated everything PE said in the letter). Bit disappointed and fed up because if they do take me to court it would be difficult going in with three little children 3.5yrs and under.
