          Well Chaps, I called them and they said they couldnt talk on the phone but they will make a note of the call and I must email them, I done that incl the email yesterday, still heard nothing, :tinysmile_cry_t:, looks like I will have to attnd the court then

            So they told you on the phone that they couldn't talk to you on the phone msl:

              What annoyed me "M" was that they wont talk about a deal on the phone , they will only accept the £150 unless it is dealt with by email, yet the £150 is incl court costs:tinysmile_hmm_t2:, and they havnt answered my emails, just goes to show what sharks they are, they wouldnt mediate either, I should imagine a judge would fall your side with this sort of behaviour, I would love to go to court to say my piece, is there not a away I can go without the appearance of the person who the car is regestered to ie, family person?

                If you have 7 days you could write to the court advising non attendance and the court will hear the case based on what you have already submitted and you can mention a stay pending the Beavis appeal http://www.justice.gov.uk/courts/pro...es/part27#27.9

                I would try this if desperate at short notice too although it does risk adverse costs if you don't show up and haven't given 7 days notice of this.

                You can't represent anyone unless they are present. A solicitor can but as it costs that kind of negates not paying. If a case proceeds and someone is putting your side then the judge should hammer them for unreasonable behaviour.

                  Well I am really Stuck here, I want to go the court to sort this out, but my wife wont let the other family member who's name the ticket is in go to the court, can I not just get a letter signed by her to go and say my piece or take the flack for it "M"? what would happen if I went to the court without the other person?
                  Anythoughts on how to go and get this sorted without the other person attending

                    If a CCJ is granted and not paid within the 28 days it will be registered against the person named on the claim form if they do not appear to defend the judge may refuse your input .

                      I wouldnt let that happen Wales Man, if I can get the other person to come along am I right in saying I can defend them and all they have to do is be there to confirm who they are and agree for me to defend the case?

                          Yes, if you can get the defendant to court you can defend them.
                          I believe that the court under (3) below could allow you to do so even if the defendant was not present, but I think you would need a b****y good reason

                          CPR PRACTICE DIRECTION 27 3.2

                          (1) A party may present his own case at a hearing or a lawyer or lay representative may present it for him.
                          (2) The Lay Representatives (Right of Audience) Order 1999 provides that a lay representative may not exercise any right of audience:–
                          (a) where his client does not attend the hearing;
                          (b) at any stage after judgment; or
                          (c) on any appeal brought against any decision made by the district judge in the proceedings.
                          (3) However the court, exercising its general discretion to hear anybody, may hear a lay representative even in circumstances excluded by the Order.

                            Maybe if I drove to the court and spoke to them personally prior to the case do you think they would listen and decide there and then if it is OK for the other family member not to go and let me represent?

                                Can you not point out to your wife, that other than confirming they are there and who they are, it is most unlikely that they will have to speak (except to answer the odd question from the judge).
                                You will be pointing out to the court that as the claimant is not present (there will only be PE's rep from (probably) LPC Law), and so it will not be possible to cross question the claimant.
                                So you ask the court to confirm that as the claimant cannot be examined it would be unfair and unbalanced if the defendant was cross questioned.
