        Trading Standards officers have found parking meters that are rigged and have powers to seize them and, if necessary, seek an order from the courts to destroy them. Speak to the local TS in the area where this car park is. You never know, they may have had other complaints about this particular car park and its parking meters and your complaint may be the one they need, together with other complaints, to take action.

          hi all.
          I have to go to county court on19 august 2013 with parking eye as i was 29 minutes late getting back to my car apparently. they issued me with the court papers and stated they would send me the relevant paperwork against me within 14 days. It took them 29 days to send have a post dated letter...Was wondering if I could use this against them in court and if it is enough to get the case dismissed.please help.......

              Hi Labman .......Updating from the 8th February - I have now received demand from Debt Recovery Plus Ltd. on behalf of Parking Eye for increased amount of £135. I will take your advice and ignore as I did with previous correspondence from PE. Thanks again for your help.

                Thank you for your help on this matter, i have now filed my appeal to parking eye, i included the confusion over their clearly stated Private land within their Parking Charge notice. Needless to say i attach the photo of the 30 foot tall blue sign that very clearly states it`s public land. I understand it`s a small point however it show that there are inconsistency even at this early stage. I will expect a POPLA code as this seams the norm but lets see what happens.

                I will start a fresh thread if i get a POPLA code, and thank you for your help.

                  Hi Legalbeagles, I have searched a few forums to see if my situation had been replicated and I can’t.
                  I today received a PCN from Parking eye, usual £100 nonsense.
                  I recently Parked at the Park Inn hotel in Heathrow, however when I went to pay, you had to use coins (no card payment facility). I had none so decided not to pay. I was meeting a lady friend for a drink in the hotel for a couple of hours so took a chance, but paid with cash for drinks so have no proof of having used any of the hotel facilities. The excitement of the meeting maybe got the better of my logic, so all my fault on the face of it
                  The general consensus seems to be ignore all letters etc. My concern is, if it went to court what defense would I have if any?
                  Please advise

                    You could revisit the car park (probably best to park outside it!) and see if signage etc.... is all correct, font size, correct font, etc.... all is important. Wording in the letter must be compliant, and certain words are forbidden, so it is worth a detailed scrutiny of their paperwork. Other than finding something on site, your best arguments would be, in my opinion:

                    1. Proving the amount paid is a genuine loss and not a penalty.

                    2. Proving the existence of a contract with you.

                        If PE cannot prove the two points you have mentioned, Labman, I would say they are stuffed.

                          Morning all, I recently went on holiday to Lake District, and stopped for sight seeing at Coniston, where we paid for parking in the car park coverred by Parking Eye. THis was 1st time we had come across one of these camera monitored car parks, and so were particularly careful about what to do. Were a few issues with machine not initially accepting coins, but it did in the end, and a ticket was bought and displayed on our car. We have since recieved the PCN from Parking Eye. I have initially replied via e-mail stating that we had bought a ticket to cover our time , and asked them to provide evidence of that ticket. They have ignored or overlooked that request and have again sent a letter stating my appeal has been referred for further information ; basically still asking for name and address of driver, information that so far I have declined to supply.They also state that PCN has been put on hold for another 14 days for me to provide additional evidence ( name and address of driver). But the Large paragraph immeiately before that WARNS me that after 29 days after the PCN was issued the charge goes to full amount, and rattles about warnings issued under various paras of the Protection of Freedoms Act, which is all very intimidating.
                          I have seen on other posts here about appeals /. complaints. How do I go about this.

                              The first thing to do is contact the hotel and explain that you were a customer etc and try and get them to cancel. As it was a P&D they might be less keen to do so but it's a free shot.

                              Secondly never say or imply who was driving as they have certain hoops to jump through to go after the registered keeper and sometimes struggle to do so.

                              Thirdly, do not ignore. It's old advice and not the best way to proceed. You should keep all correspondence. You should also appeal to Parking Eye so they can refuse your appeal and get your popla code to appeal to popla which has a great chance of success based on current thinking. Remember when appealing to write "the driver" and never "I".

                              If it goes to court (unlikely if you appeal to popla) your defence will be the charges are penalties and not a pre estimate of loss.

                                If you can find out the landowners of the site then try complaining to them it sometimes works.

                                Do not admit who was driving and always refer to "the driver" rather than "i" "my wife" etc. Put in an appeal such as "The driver paid for parking and as such your fine is false but even if i hadn't you fine is a penalty and not a genuine pre estimate of loss" If you have the ticket send a copy. If not they will refuse your appeal but should issue a popla code upon receipt of which you have a great chance with a popla appeal.
