Ok, hope its ok to post on this thread, my husband recieved a parking eye notice in february, i had read on forums to ignore all letters which we have done, but we have got a new one, now this one has me worried a bit, its a LETTER BEFORE ACTION, as you are the registered keeper, you are liable for pcn, this was because requirements of schedule 4 of the protections of freedom act required for keeper liability have not been satisfied blah blah.. because they have not recieved the £85 we must inform you you have 14 days or further action WILL be taken and COURT PROCEEDINGS will be issued. now thats got me uncomfortable because i have read on pepipoo that the advice to ignore has changed as they really are taking people to court, what do i do now, should i contact the shops on the retail park which has a free 2 hours for shopping in 11 shops and a mcdonalds restaurant,

The have no legal right to fine you. They are not the police or a government department.

Kepp it safe just in case they are stupid enough to try it on,especially if it says fine on it, but you should ignore.

Hi, I have read lots on here about ignoring all these demands from Civil Enforcement Ltd. But I received a genuine court claim in the post the other day. Can somebody please help with what to write for my defence as they now want £350.00 plus costs if I lose.

Follow the links to Pepipoo, as they specialise in this sort of abuse of the courts.

However, I might suggest that subjecting their claim to strict proof should work, as they've obviously not lost £350 or anything close to that much.

even though my overstay was unintentional it was an overstay and thats all the court will care about, not why's or wherefores

Start your own thread.

Particulars of claim, all letters from parking eye, whether it was a ticket on the car or a letter through the post, whether you paid anything or was it a free car park etc.

Sorry to hear this in your case. I might be next as I hve just returned from hols to find another threat-o-gram from DRS - now offering me a reduced rate if I pay up as "someone" does not want to take court action - well bring it on I say. On top of that another goody as well - now from TPS - very suspect letter with grainy pic of car and barely recognisable blacked out one of number plate - stating - Charge Notice - Final Reminder - Legal Action Pending - all in large red letters - threatening comes to mind in a big way - not had any letters prior I might add and it was not me driving - but thanks to this bloody stupid law - I am the fall guy/silver surfer - again! Well watch this space folks - totally po'd with this scenario and all stores concerned have now lost our patronage. If I get taken to court they will all hear about it. Start your own thread as Mystery says. Also join Pepipoo www.pepipoo.com (free to join) who are excellent in defending these.

It probably wasn't there when you first posted.

A main defence having read your first post would be it was a free car park, so what loss have they incurred. If it charged £1.00 per hour, possibly you would owe them 50p. It is free so they have lost nothing. The 'Parking Charge' can only be seen as a penalty and is disproportionate to any loss incurred (in this case zero).

It may also be worth visiting the stores and speaking to the managers of them to explain what has happened. They seem to be realising increasingly that the parking restrictions are not good.

Further to my "bleat" about TPS - store in question has now agreed to take up the case - spent a lot of money in the store and was advised that overstay was fine while there as they could not sort out the prob so had to wait - they will now deal with it - this ultimate conclusion was not without a hassle I might add - but live in hope that this is the case! Parking Eye and now 8 months on I have no clue as to what will yet ensue - that's another matter - but not throwing in the towel at all. Stay strong all whom have fallen foul - we need to get a "fair" result

If I may make an observation, making a threat to take someone to court when you do not have a right or grounds in law to do so, no matter how justified you may think you are in doing so or think the other person is so dumb or compliant you will get away with it, is a serious matter, in more ways than one. Any PPC and their DCA attack dog who think they can get away with - even if they do get away with it initially - is going to get their comeuppance. And it will not be a nice experience when that comeuppance comes.

Agreed!! Firstly, what a wonderful site this is and secondly, I just got a letter from them with lots of legal gobbledegook and saying, (quote), 'don't believe what you read on the forums'!! The cheek of it!!!!!

I've got as far as POPLA because I'd already responded to them before I found this site. I 'appealed' and told them that they needed to respond to me at my foreign address as I was only visiting the UK temporarily and I didn't expect to hear any more from them but I really do wonder if they'll be foolish enough to try court proceedings against someone who isn't even in the country. Do they think I will care?
