    Interesting point.......There is no option to pay at the carpark or store for any time exceeding 90 mins.

    The store manager has advised that if customers need to go beyond the 90 mins then they should make a member of staff aware of that.

    I see where you're coming from, but wouldn't the contract's ts&cs supersede that argument, which are that any period of stay beyond 90 mins equates to £100 fine.

      First it's not a fine, it is an invoice for a parking charge.

      If you are not allowed to park for more than an hour, you then become a trespasser.
      There is no contract to park beyond an hour
      You can't contract to do something which is not allowed

      I'd certainly would be prepared to argue the poinr in court, and i think a google search could throw up similar situations, but at the moment I don't have the time.

        Should have mentioned that the Beavis v Parking Eye revolved round similar circumstances, but Mr Beavis lost on the argument that this was a
        contractual penalty charge

          If the store are offering an extension when asked then the full contract has not been given by the parking company and you can reject the alleged contract they are holding you to.

            Wouldn't any discretionary arrangement offered by the store be detached from the PPCs contract?
