    Input Para 4:

    4. The Notice to Keeper issued to the Defendant fails to specifically identify the location in which the alleged incident occurred as required by the Protection of Freedoms Act 2012. The address and postcode provided relates to two separate Car Park areas.

    Amended Para 8 (subsequently now 9):

    9. The Defendant wishes to also advise the court that the signage within the Car Park fails to comply with section 18.3 of the British Parking Associations Code of Practice. "Signs must be conspicuous and legible, and written in intelligible language, so that they are easy to see, read and understand". Based on the alleged incident being at a time of darkness in the evening, there is a failure to adhere to this as absolutely no lighting is provided within the area of the Car Park. Photographic evidence provided by the Defendant can confirm this.

          Update with this. This case has now been assigned to my local County Court for a hearing on the 17th December. Civil Enforcement have been given until the 19th November to pay the £25 fees to proceed with the case.

          I also agreed to the request to speak with a 3rd Party to find a resolution without the need for a hearing a couple of weeks prior so do I take it Civil Enforcement did not agree if this has now been assigned a court date?
