  • copart sold my car without my consent

on the 12/11/2024 i had a car accident [ none fault ] i contacted the aa who in turn put me on to a company called ax-uk a 3rd party insurance company they took over from my insurance company they told me to cancel my insurance with geoffrey insurance as they will do all the work so i cancelled my insurance with them i emailed ax the damage done to my car. just the front bumper and headlight needed replacing they told me it would be written off due to the age of the car they sent a company called copart a salvage company to collect my car who in turn told me my car is only worth £210.99 scrap value[ they even sent me a cheque which they later cancelled as i told them i refused there offer] i told ax i wasn't going to accept coparts offer and would like the car back so i can repair it my self they said ok. the 3rd party paid out £1.420 i was told by ax copart would send my car back to me. i never heard nothing for a couple of weeks until i looked on coparts website my car was up for auction i phoned ax and told them about it they said they will contact copart and call me back about 1 hour later they called back telling me they spoke to copart and said they will take the car off auction and send it back to me they didnt they sold my car copart keep telling me they are investigating this has been going on for weeks now now i have a letter from dvla saying someone has requested a new log book im fed up of copart fobbing me off with excuses i now have to walk and and get public transport

I take it you only had 3rd party insurance with Geoffrey so would have had to pay for repair work yourself as it was a no-fault accident.

What I fail to grasp is why the 3rd party (ax-uk or the other driver in the accident?) paid you £1420?

What did Copart tell you before or when they picked up your car?

Do you mean you were fully comp? You stated you cancelled your insurance?

When ax-uk paid you £1420 they became the new owner of the car. Was it ax-uk that contacted copart salvage company to pick up the car?
Did you hand copart the log book?

Copart make their money by paying on average £200 to £300 for cars written off (beyond economic repair) transporting them to their salvage yard to be auctioned or broken up for parts to sell
If you were free to do what you wanted with the car why did you let copart take it and not arrange the repair yourself using the £1420?

IMO you do not have a strong court claim
You should have contacted ax-uk to enquire about keeping the car before they arranged for copart to collect it
