Pcn received after 7 weeks

Hi I received a letter from smart parking regarding parking my car at the airport pub Manchester Airport. This took place in August, I got nothing till November when I got a letter from smart parking saying I had 2 pay £100 fine or £60 if paid within 14days of date issued which was in September. I couldn't contest it as the 14 days had passed. I've tried to get in touch with smart parking but no phone contact. Can you please advise me where to go from here.

Firstly you do not phone Smart Parking, and if you write to them you do not identify the driver.
Do not identify the driver when posting on the forum, as parking companies do monitor these sites.

Post up a copy of the PCN, first removing identifying details, but leaving visible all dates and times.


Tagging ULA could you please edit post 1 (remove second sentence) so driver cannot be inferred.

So write to Smart Parking as follows.

Dear Sirs

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

That's brilliant thank you so much, I will keep you updated on everything. I didn't mention I have kept the original envelope and also should have evidence of delivery as I have cameras on the letterbox.

Hi I've just received a notice to day from debt recovery plus today saying I owe £170.00. 2 days after I sent the letter to smart parking I received a letter from the debt collection agency stating they were now involved. They have a contact number, do I ring them explaining I sent a letter to smart parking.

Do not phone anybody.
Work on the basis they are not trustworthy and only want your money.

Debt recovery Plus are only debt collectors with no teeth.
You could write to them, informing them the alleged debt is being disputed and accordingly they should return the matter to their principals and cease writing to you.
