Hello
I am retired living on Pension credit with my wife in Harrow in Middlesex, My problem is I have a son aged 19 living at home, he has just finished collage on the 1st Sept 2014, when he was at collage we were getting Child Tax Credit of around £60 plus Family Allowance of £20 per week, since the 1st Sept 2014 he has been claiming Job Seekers Allowance of £51 per week, as you can see we are getting round £30 per week less, How we are supposed to feed, clothe, heat him and give him money for buses and trains to go out looking for work on £50 is crazy!!
But now Harrow Council have sent me a council tax bill for £3.70 per week for a none dependant living with us is just mad, we are getting £30 a week less than when my son was at collage (when we did not have to pay any council tax).

My question is can we do anything about our situation, as I said we are only on pension credit, and everything seems to be going up in price electric, food, heating

Hi Bazza08 - sorry this had been missed
How much will be deducted for a non-dependant?

If you have a non-dependent adult living with you, the amount of CTR you get will be reduced. The amount your CTR is reduced by will depend on the circumstances of the adult living with you - on how many hours they work and how much gross income they earn.
The table below shows the amount which is taken off your CTR, depending on the circumstances of the adult living with you.
Not working or working less than 16 hours a week £3.70
Working 16 or more hours a week with average gross income less than £188 a week £3.70
Working 16 or more hours a week with average gross income between £188 and £326 a week £7.45
Working 16 or more hours a week with average gross income between £326 and £406 a week £9.40
Working 16 or more hours a week with average gross income £406 a week or more £11.25
Does the council know that your son in getting JSA?? I'd suggest you have a word with the council (or someone from CAB - http://www.adviceguide.org.uk/england.htm) as it seems like you should be getting the full CTR with no deductions:
A deduction won’t be made from your CTR, even if you have a non-dependant adult living with you if the adult:
• is someone who isn't counted when the local authority works out who lives with you – for example someone who is currently in prison, or someone who is severely mentally impaired
• is a full-time student
• is a 16 or 17 year old
• is staying temporarily with you but normally lives somewhere else
• gets Income Support, Pension Credit, income-based Jobseeker's Allowance (JSA), or income-related Employments and Support Allowance (ESA)
• is doing youth training and getting a training allowance
• has been in hospital for more than 52 weeks
• is a member of the regular or reserve Armed Forces who is temporarily away on operations.

Hello Kati

Thank you so much for your help, I have informed the Council that my son is getting JSA, and I have asked for meeting with them, can I quote the information you gave to me re:-A deduction won’t be made if he is receiving JSA, as a legal condition, … is this a Government rule?

Once again thank you very much for your help

Hi Bazza, my quote was copied and pasted from the CAB (England) website, so YES you can quote it :tinysmile_twink_t2:

You'll probably be asked to provide proof (any letter from JSA should be more than enough)
