  • What is a Certificate of Service (N215)?

    Hiya.

    I am a newbie here and I hope I am asking my question in the correct section.


    I have so far followed correct procedures, I believe, by sending someone who owes me £5,000. I mailed them a detailed breakdown of how and why they owe this money following the Practice Direction on Pre Court Action Conduct. I've even offered to go to mediation service rather than waste valuable court time etc. AND, I drew their attention to section ii (4) of the above, which gives the court powers to impose sanction if they do not reply with 28 days. So, Ive done all that.


    I have now filled my claim with the county court using the online service.


    Now, it mentions a N215 form, which is a Certificate of Service. Does this go to the judge/county court or the defendant too? And do I send my evidence to the judge with this form?

    The Certificate of Service should be filled out, listing, and attaching all the documents you have served on the other party, and to which address (or nominated legal representative).

    You use the guidance sheet on the back to calculate the date of service (eg, by first class post is the second day after posting).

    1) Send the evidence bundle with COS to the other party
    2) Send exactly the same bundle of evidence with COS to the Court.

    Signing the statement of truth on the COS is you telling the court under oath that you have served the documents on the other party,

      What are you sending separately to claim form before you send anything to anyone?

      Is it "Further Detailed Particulars of Claim?"

        Oh I see, so the Court have not served the Claim From on the Defendant yet?

        if the Court has not serve the claim form on the defendant for you, and have just returned the sealed claim form (ie, stamp/dated) then yes you will need to send everything, and list everything within the Certificate of Service.

        The Certificate of Service is just proof to the Court that you have actually served the documents.

        You would then Calculate the date for the Defendant's acknowledgement of service.

        If they do not respond by 4pm that day they should acknowledge service, then request judgment for failing to acknowledge service.
