My daughter was caught stealing at a local chain retailer. They didn't press charges and just banned her from the store for life, and she has been banned from the actual shopping center for a year.
She admitted to me that she's done it before about 6 weeks ago, and she was afraid that they would decide to go through all the store footage, find her doing it a second time, and have her arrested. I said it's unlikely they still have footage from that time or that they would bother searching for a needle in the haystack, and not to worry, but she is still worrying. She's very embarrassed and ashamed of herself and is unwell, suffering from depression and anxiety, which is what I think the cause of this uncharacteristic behaviour. I want to reassure her, but have no real knowledge of common practices or legally what could happen to her, so she's not taking much from my reassurances.
How long do stores usually keep footage before writing it over? Are they allowed to keep it forever, or is there a standard period before having to get rid of images of the general public? What are the chances of them looking for her on the footage for the chance of any past offending and having her arrested? she has a clean record, and this is the first time she has ever been in trouble.
She admitted to nothing aside to the one she was caught red handed with. She's wanting to appeal the shopping center ban, but is worried if she does, they'll get the shop in question to start digging to see if she's done anymore thieving in their shop, and will end up in more trouble if she fights the decision.
Thank you in advance for any help or advice you can give me.
