Re: Bryan Carter Letter - Urgent advice needed

    Hey FMM,

Don't let them upset you like this, I'm sure you are a very good mum doing the best you can for your kids!

We have all been there, back in 2006 before I'd found this place and "the other forum that shall not be named" I feared them as much as you.

As FP has said above, even if they got a court order, it would only be for an amount you can afford - but we will do everything we can to help you

The letter template I have given you should be a good start and may make them think twice if they dont have adequate paperwork to back up their threats - time wil tell, but whatever happens we will do our best to help you

The people on here gladly gace their knowledge and time and helped me see the true picture.

      Hmm,

Just realised its Capital One - a credit card I presume?

Don't want to get your hopes up, but their paperwork for mine was completely inadequate, here's hoping it's the same for you!

Another thought - are there likely to be any late charges or PPI within the balance owed to Capital One?

        Morning!

It's really nice of you, and it's much appreciated. I know I'm quite depressed at the moment, not helped by the fact that my littlest horror has taken to waking numerous times in the night and is up ready for the day at 4am. I look to the future sometimes and I just don't see things ever getting any better, unless a blue chip company should suddenly find themselves in deepest, darkest, Cornwall and decide that I'm a must have member of staff :tinysmile_aha_t: We also live in a very affluent area, so my kids schoolfriends are all extremely well-heeled, families ride with the local hunt (no kidding) and have all the trappings. So I look at mine and think they'll one day be mortified that me and their dad will probably still be staggering around in the clothes we're wearing now! lol University for them? No. Money for 21sts, weddings? No. When we do finally shuffle off our mortal coil all that'll be left to them will most likely be (at this rate) a very collectable pile of Bryan Carter letters. Yep, I'm on a major downer alright!

Anyway, that was semi-cathartic and now that I've bent your ear, I've got a pile of housework to get through and a letter to get into the post.

Yes, it was a credit card, it would even be worth it if I'd spunked the money on the holiday of a lifetime but, I didn't I have no idea if there were charges or PPI, I spent the money once and seem to have been paying it off for the last hundred years or so. I guess I'll find out if they comply with your letter.

You really have been a great help and thank you.

sit back look at the kids and think they are more important than ANYTHING I have no doubt you like many of us on here never set out to get into debt it matters little in the grand scheme of things the Children come first the debts go in a short period of time paid or not ,
remember as others say on here there are plenty of us deep in debt most of us would rather not be

If you get threats of doorstep collectors or field agents, there's a letter you can send to revoke the right to visit you. Bear in mind those collection agents have NO RIGHTS WHATSOEVER, no more than your neighbour's cat! They are NOT bailiffs. :nono:

                Dear Sirs

                Ref: xyz

Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me over the past few weeks and these have been duly logged by time and date. Should it be your intention to arrange a doorstep visit, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

                Yours faithfully,

With regards to telephone harassment, you may want to look at this thread: http://www.legalbeagles.info/forums/...om+harrassment

It is important to log every call you receive, even if you don't answer them.

                  Hi Walesman,

I know they're more important than anything and they're such good kids, they don't ask for or expect a lot. I know money isn't everything but, I so want them to be able to look back and think of their childhoods as being good and yet, I feel like they're going to remember it as a bit crap really! Can't have this, can't do that, and mummy hiding behind the sofa (not literally, yet!) meanwhile their friends.............

I know I need to get my head out of my backside and I will, in a couple of days or so!

Thanks for the info! If I were to log every call I'd probably need to employ an assistant, I really want to invest in one of those truecall thingys, it'd make life so much easier. Well, letter sent today so will see how the land lies, he'll probably just tell me to get stuffed :-)

My parents were wealthy, we had a big house Rolls Royce etc but as parents they should not of been allowed kids - now having three kids of my own and being in your situation I would rather spend good time with them than buy them the latest fad.

I am starting to see light at the end of my tunnel and it has taken years to even get into the tunnel so please keep going and follow the advice here.

                      Good luck!

When you're a kid, what you enjoy the most is time spent with your family and your friends, playing, etc. as well as the support you get form your family, rather than all the expensive stuff.

If you can show them a good time without spending money, they will remember their childhood being a happy one, unlike many rich kids whose parents are never around because they are too busy working and/or socialising, are left in the hands of nannies and au-pairs, etc.

One last thing, if they did get a CCJ would they be able to come and take things to cover the debt? We really don't have anything of value, still in the land of the non-flatscreen TV and ancient fridge/cooker so I am really worried about my car as we just couldn't manage without, couldn't get to work, doctors/dentists. I know I'm getting a bit ahead of myself but, I need to know what we may be facing.
It is unlikely that any bailiff would want to seize your jalopy, as it wouldn't even fetch enough at auction to cover his fees and costs.

Under EU legislation, bailiffs are not permitted to take away your children in settlement of a debt.

Faith,,hun now listen up to an old bird who has been there, done that, got the Tshirt, read the book, seen and starred in the film and been round the block so often me backside has it's own postcode :marchmellow:
My Mum + Dad,God rest their souls, weren't perfect,,the ole fella was a philandering old git and Mum popped 6 of us out with barely a pot to pee in.
We didnt have the latest gadgets and gizmos (well,,I did but I;m the youngest so the others spoiled me) BUT we knew we were LOVED....No matter what,my parents did the best they could for us and one thing they installed in us was a good moral compass,,none of us are perfect,we've all screwed up. I've been drowning in debt before and it really messed with my head but I had to keep going for my son..and so will you.
As long as your kids know they are safe and loved that's all that matters and if you are trying to 'keep up with the Jones's' you are going to miss all the little things that make this old world turn.
All you need to do is give your children the one thing money cannot and never will buy....LOVE.

Chin up,chuckles,,this won't last forever,,and the Beagles will help you sort the money side out
Dry your eyes,,wipe your face (cos a red eyed, dour faced, snotridden Mummy is NOT a good look msl:..and breathe........................................... ..................................
