        You're feeling better because you are being pro-active,,taking the swines on and making them work.
        What you need to remember is they can't kill you,steal your children or take your Granny's chamberpot hostage (bit of luck her chamberpot is Royal Doulton and worth a fortune in years to come lol)
        And...either switch the ringer off or unplug the phone when you have visitors....and if you do answer it never say Hello first cos if it's a call centre ringing you your voice will put the call through to a person. ( I never speak first,,even all these years later,,drives my family insane lol)

        Yes, you were right! This site is invaluable for people like me who are woefully ignorant of the ins and outs of it all. I do feel better in actually tackling them but, I fear I may be tempting fate, well we'll see. As for the phone, I quite often have my in-laws here for days at a time, which makes life dodging DCAs ringing up rather difficult, they must wonder at the amount of "telesales" calls I get.

        You don't need to give financial advice, you're brilliant at putting a smile on someone's face at a time when it's needed, so well done you! Love your humour.

          With regards to phone calls, you may want to look at this thread: http://www.legalbeagles.info/forums/...om+harrassment

          You should log all calls you receive, once you've read the thread above, you will see why and how that could work in your favour :thumb:

                Well, sent it 1st class (can't really afford to keep sending special delivery) At the risk of irking Mr Carter, I just wanted to rubber stamp that I won't be a pushover (little do they know) So they'll probably go all guns blazing for me now! :whip: Oh well, can't get blood out of a turnip.

                  There's no need to send every letter recorded delivery, just the ones you'd need to track for legal purposes, such as CCA requests, SARs and requests under the CPR. It's also a good idea to use RD to respond to letters from solicitors that threaten legal action, otherwise the rest can just go 1st class.

                    Nothing further from either BC or Lowells/Fredrickson. Am feeling slightly uneasy, is there any possibility that they might have sent court papers to a previous address? I doubt it but, the thought has flitted across my mind!

                      If you think there may be a CCJ against you, this is where you can search the public record: http://www.trustonline.org.uk/search-yourself

                      It'll cost £4 but will give you peace of mind. :thumb:

                        Hi all,

                        Right, today I received from Mr Carter a copy of the credit agreement and copy statements going back to when the account started, I didn't receive any of the other documents which were requested. However, although the credit agreement is a rather blurred photocopy, it's not so blurred that you can't see that I didn't tick the box for PPI and give my signature saying that I understood what I was purchasing. Since the commencement of this account they have religiously applied PPI so, I imagine, that I now bounce it back to Mr Carter and insist that the account is corrected, along with interest? I make the total amount of PPI to be £330 (not including interest etc)

                        If I do this, can he just insist I still pay what they're claiming and take me to court? I don't mind paying what I owe but, I do want this offset prior to entering into any agreement.

                        Any help would be great, particularly with wording!

                          S.61 of the Consumer Credit Act states that copies of agreements should be legible:
                          61 Signing of agreement.

                          (1)A regulated agreement is not properly executed unless—

                          (a)a document in the prescribed form itself containing all the prescribed terms and conforming to regulations under section 60(1) is signed in the prescribed manner both by the debtor or hirer and by or on behalf of the creditor or owner, and

                          (b)the document embodies all the terms of the agreement, other than implied terms, and

                          (c)the document is, when presented or sent to the debtor or hirer for signature, in such a state that all its terms are readily legible.

                          To reclaim PPI, you have to contact the original lender, as they are the ones responsible for mis-selling it and/or applying it to your account without your consent. Bryan Carter are just solicitors acting for a debt purchaser and would have nothing to do with the PPI, however, if they contact you again asking for payment, you can send them a copy of your letter of complaint to the original creditor.                           See above. If they write to you again asking for payment, post up the letter here to sort out an appropriate response. Don't make any offers to them. The wording would also depend on what they've sent you as purported agreement, hence the idea of posting it up. :typing:

                            Hi,

                            Sorry, three day camel ride....not good with techy stuff. Hope that's ok, page 1 of 2 with the second page just being endless, barely legible t&cs.

                            I have no idea where my attachment is going, have done the 'manage attachments' and upload then it just says it's waiting for legal beagles and a blank screen. Have tried adding it to photobucket and uploading that way but I can't seem to get it to work.
