    Hi
If someone (who is DPA registered) holds data about myself can I force them to remove them from their files if they are no longer relevant (profile removed)

It depends what it is. Some data has to be kept for a certain number of years. I assume we're talking about data which is held electronically?

Who do you think! I don't want to go into details but I do not want to be contacted by him again in any way

They could say they have removed the info but how would you be able to check?

Re: DPA and data held by third party

There is no reason for that information to be held at all by the site anymore. I assume you have only contacted him in his formal capacity as webmaster or other site related email address.

I don't know if he intervened with any creditors etc... on your behalf? That might give a reason to hold your data. I believe SAR's etc... have gone unanswered, so quite how much the DPA means to him I am unsure.

Principle 5 of the DPA http://www.ico.org.uk/for_organisati...ds/principle_5

Personal data processed for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.
If you have concerns over your data being held or used inappropriately you should contact the ICO for advice.

You can ask a data controller not to use your personal details for purposes other than their main purpose – for example for marketing. Similarly, if you feel that the organisation or person does not have a valid reason for holding your personal details or that they have taken these details in an unfair way, you can ask them to change or remove these details. In both cases, you can write to the organisation or person, explaining your concerns or outlining which details are incorrect. Within 40 days, the organisation must do as you ask or explain why they will not do so. You could then, if necessary, take the case to the ICO.

I'm speaking primarily about any personal financial data/documents you may have chosen to share with the Data Controller that contain sensitive information.

If you are receiving personal contact that you would rather not receive you can ask that this stop - you could also set up blocks on your email account if necessary

Never acted on my behalf apart from what was public but have spoken on phone. He has seen most of my s78/79 requests and made various declarations on them. Some not correct. I am classed as inactive so would like all my details removed

Amethyst. Thank you for that. I will email asking for all copies of personal financial documents to be deleted as well as my email address. I will also ask that anything that could be linked to me is also removed. It is sad when any relationship goes sour but sadly a drowning man clutches at straws. Non the less their help was invaluable at the time and done carefully works well

No need to hold documents after they have been seen and scrutinised. I assume from your second sentence you want all your posts removed?

Not necessarily but I wouldn't object if they were. It is mainly the personal details that I would like deleting .
Thinking about it there will be posts that have been deleted that may still be on the server so maybe all posts would be a good thing

Where does the OP say it is an internet website :confused2:

Where does the OP say the information relates to personal information passed to creditors or the webmaster has intervened with creditors in any way :confused2:

How do you know SARs have gone unanswered by the website which the OP hasn't mentioned :confused2:

Has that assumption been tested in court?
