        If this guy wants to sue the hospital he needs to see a specialist solicitor who may take it on a no win no fee case if not he will have to cover costs to take the hospital to court with no guarantee of winning ,
        good luck to him he will have a long wait

          You did recieve treatment here - what you did not receive was the tretament you thought you should get. And that so far, is the only fact. You are claiming that the damage was significant and was not treated. But in fact you were told what to do - painkillers and/or anti-inflammatories and RICE. That most certainly is treatment. So you are going to have to show that the diagnosis that your Polish doctor made is correct, that the teratement he undertook was necessary - and that will not be at all easy since medical practices vary across the world and what may be deemed appropriate in one country may not even be permiteed in another! You appear to be oblvious to the fact - so I will tell you - that it is not unheard of for foreign nationals to attempt to sue the NHS in collusion with doctors from their country of origin who have fraudulently made up diagnoses, either to inflate their income, or to collude in fraudulent claims. I am not suggesting that you have done this, but you can be quite certain that the court will look at this and consider that as a possibility - and so will the NHS lawyers.

          For your information, I have seriously torn ligaments in both ankles which continue to tear, a damaged hip and damged back (so just a bit more than a bad knee), now ongoing to over twelve months and the recommended private treatment for this, from a top consultant, is not X rays (you should not have X rays unless absolutely necessary because of contingent risks and potential build up effects - in the UK X rays are avoided rather than given!), RICE, anti-inflammatory medicines etc - in fact everything that you were told! So this is not as easy as you seem to think - and not would I spend the compensation that you may or may not get yet - contrary to received opinion, it won't be as much as you think.

          By the way - if you were in so much pain, why did you leave it months and months and do virtually nothing about it? You outline a few calls and a couple of visits to the GP over a lengthy period - the court is also going to be questioning why you were not more persistant.

              I certainly couldn't suggest that the OP is being litigatious and chasing compensation - but I am damned certain that their opponants will be! That is the point that people forget - go to law and you do not get everything your own way, things can blow up in your face, and you may get a result you didn't bargain on. I see so many similar circumstances in employment law where people may very geniunely believe that they have a case and are headed for the high life - when in fact neither are true.

                Thanks for your post.
                Yes,I get the treatment here and advice.Fact.It was wrong advice or not I don't know.After 18 months I resolved my knee problem but thanks only to private visit with Polish doctor.I didn't used Polish National Care I paid for the visit.
                I was visited my GP very often and he contact with the Hospital many times to arrange appointment but after first visit they didn't find any problem with my knee that's why I didn't get more appointments and the Hospital rid of me from the waiting list.
                In Poland the doctor say that is serious injury and I spent there 7 weeks.I don't want to prove it who is right or not.I don't have any help apart advice to use painkiller and ice to my injury.That's fact.

                  Robinson74, have you taken the advice given either by Celestine which is to speak with a medical negligence solicitor or by myself which links you through to making a complaint with the issue of compensation?

                  The Doctor diagnosed and gave advice, personally, I think the medical side of things in terms of diagnosing and advising was correct however, there were aspects of the after care that I do think are at issue. Advice was given by Celestine and myself so that is the advice and it is up to you how you use that advice.

                    I have a back injury (amongst other things) resulting from negligence - which is a separate story and being handled fine.

                    But one very well qualified and experienced consultant tells me that I definitely need surgery on my spine, and that if I do not have it then my spine will deteriorate further. Another very well qualified and experienced consultant tells me that surgery is a very radical answer, a last resort which I should not even contemplate at this time, and that there is still a real prospect of some, if not full recovery - and that surgery may make things worse and not better. And they are in the same hospital, never mind in a different country!
