  • Mortgage Miss Selling

    In April 2009 I started a claim for compensation for mortgage miss selling. The claim was always made against the authorising network but unfortunately they have now gone into liquidation. The FSCS investigated the complaint but did not uphold it.

    What I would like to know is whether it is possible to complain to the broker themselves rather than the authorising network? Surely the broker should still be held accountable and liable? I believe the FSCS dismissed the claim because they did not want to set a precedent and if I still hav any form of redress with the broker I may still be able to use FOS or county court claim under section 150 of FSMA 2000.

    Hello every one I am a disabled perspon who was sold a mortgage with swift i have now found out that i was missold the mortgage and that swift were aware that i had been missold the mortgage i have obtained a copy of the there computer history record showing the fact that i had a serious mistake and missunderstanding when purchasing the Mortgage .

    I was sold the mortgage and swift knew that my only income was on Benifits i borrowed £120,000 and i now owe £160,000 i was sold an interest only mortgage fixed to the base rate the broker has confirmed this but swift say its fixed to the libor rate.and the mortgage can not be maintained by my benifts i have now taken this to court and issued a claim under the breaches of the Mcob rules luckily i found a solicitor who was looking to take on these cases and many other cases with similar problems ie interest rate over charging, miss sold,repossesions due to non affordability i couldnt afford to pay a solicitor and legal aid is just so hard to get now but Richard and daniella from ultimate law came to my rescue and are now funding my case on a no win no fee basis . I thought i would write this to let every one no there is a company out there to fight your corner if you have a problem with swift adances or swift 1st ltd you have a right to be represented and to have your case defended and argued correctley in law as well as to have your case re-looked at again under an appeal if nessasary,i wouldnt want this to happen to any body else like me and also in a vunreable position like me disabled with an illness .

      Can you let me know who they were as this happened to me and i have let the legal ombudsman deal with it as they have an insurance policy in place to reimburse you for any mistakes . Andrew
