  • Can I claim for time and mileage if the matter goes to court?

    Hi,

    I bought a one year old car from a main dealership and found scratches on it when we picked it up (they weren't there previously)

    We then spent the next 12 months with them making multiple failed attempts at a repair.

    I have now paid for a reputable body shop to repair the vehicle.

    My question is can I claim for the time spent / mileage travelling around trying to get this sorted?

    I am just about to send them an invoice for my costs so is there a table or formula that I could use to claim the time and mileage? I have kept a log of all the journeys and the times taken travelling so I'm not just picking numbers out of the air.

    Any guidance would be most appreciated.

    You can only claim in a court for you loss.

    You'd have to demonstrate that you'd have been doing something else to the value if the amount you claim for time to say that you have suffered a loss due to spending time rectifying the issue.

    Millage is perfectly reasonable to claim in my view because the more mileage added to the vehicle the more the value depreciates and thus you have suffered a loss.

    Should it go to court and assuming the value of the claim is less than £10,000 you should be aware that costs in the claim are limited to court fees, witness expenses and interest unless the other side behave badly while conducting the claim in court.
