Re: Disciplinary invite letter with no possible outcomes

It's something I'd have to be entirely honest about, if I went for interviews in a similar field to where I am but ideally I'd want to get out of the banking industry so hopefully the dismissal on my record wouldn't hinder me quite so much if I wasn't interviewing for another bank job, especially considering what it's for since gross misconduct can cover so many things so I'll be keeping all my documents to demonstrate I wasn't dismissed for stealing or violence or anything like that. I know it will make it harder to get another job but at the end of the day, I know people who've been sacked (even someone who actually did steal from the bank) who went on to work again so I know it happens, it probably just means you have to persevere and be prepared for a lot of knockbacks, which I am. There's no point me lying about the situation as I've worked there so long so I can't give any other job for a reference as there simply isn't one. And I'm pretty sure the majority of employers would appreciate the honesty rather than finding out for themselves later. And I do have quite a few contacts in other companies who can put a good word in for me so hopefully that will help, even with a dismissal on my record.

I went through something similar in 1999, where the co tried to get rid of me on health grounds, then when that failed they tried to break me with the disciplinary process. Like with your case, they decided the outcome before the evidence really and were floundering and making mistakes. I fought them as I know how to do that (used to work in HRM) and they just tried more devious ways.

In the end it was clear that it was no longer tenable to go back and I resigned, walking away with three months salary. I actually had a case for constructive dismissal (with watertight evidence they didn't realise I had) but never did that as I'd had enough by then. I think you are right to be looking at moving on, and certainly right to be leaving that sector!

I think you should fight as later you might wish you did - though I can understand those who simply move on given the work and emotion.

Either way stick to your guns and don't go lightly.

I'm sticking to my guns, don't worry! Although I equally do understand why some people walk away because of the stress.

Just to give you an update, I called my union today just for another opinion on the situation, they were very bemused about the invite letter (and I spoke to two reps as well) and they said it should definitely have stated the outcomes in there if they're considering dismissal. They also advised the letter is a standard template with all information and possible outcomes originally included, so the fact my letter didn't have it in means it was actually deleted. It couldn't be that they forgot to add it in because it's already there. The fact the manager had then emailed me the deleted paragraph was even more confusing, not to mention the fact the email wouldn't stand up at all if this went to tribunal. They would have to send me a new letter, which they haven't done. This suggests the people in charge are either completely clueless or they know they're not going to sack me anyway so they're not even bothering to cover their backsides properly. The Union rep so ad I've definitely got a lot of evidence against them in the way the case has been handled, should I need to appeal it or go to tribunal. So that's been reassuring that two different people have said that because whilst my other half as been very supportive, it's also good to know that others who are not biased in my favour also have the same opinion.

Hey everyone, just to let you know. I had my meeting and today got confirmation the allegations haven't been upheld and I'll be returning to work with no action taken. Thanks everyone for your help, support and advice! It definitely pays to stick with it!

Xbabe - I'd be tempted after a period of time to look elsewhere given how you have been treated - they aint worth you staying around?

That goes without saying. Regardless of how I've been treated, the department has gone to the dogs in the past six months anyway so I'd still be looking to get out. I'm still looking elsewhere though I will be careful not to jump to just any old job. I'm just glad I have the time to consider my career now rather than being forced into it, as I feared I would be.
