  • Breach of confidentiality regarding a grievance

    Hi everyone

A friend of mine at work has raised a grievance against me and attended a meeting regarding this. A signed confidentiality agreement is in place, however, promptly came out the meeting and told people, not only that she had raised a grievance, but what it was about and what was said in the meeting. I only heard through whispered gossip and then was confirmed further by people in other areas of the business. I've known about this for 10 days and have been pushing my boss for confirmation of alleged grievance. This person is harassing me at work and outside work and staff are now saying that it's getting ridiculous as she is getting away with it. I said to my boss last Friday that I ought to speak to HR as this is clearly conduct issue and I wanted to go home due to having to work in a hostile environment. Should I raise a counter grievance? I feel really intimidated and can't believe her behaviours. I rated her inconsistent at her yearly review and she appealed twice, however, the rating was upheld. I also had to issue 2 record of discussions to her, one of them she refused to sign. It was sent to HR WITH A NOTE TO SAY REFUSAL TO SIGN. I'm obviously distraught as to me she is being vexatious and keeps coming to my area to harass me. Help and advice appreciated. Is her behaviours in harassing me a case for disciplinary action? What should my employers do for me?

Raise a grievance at once. Do everything in writing.

Re: Breach of confidentiality regarding a grievance

Well, I had a 3 hour investigation meeting yesterday and then my immediate line manager went after me, I was asked to sign a confidentiality agreement and I asked for confirmation that everyone involved had signed one also. This was confirmed to me. The meeting was recorded and I raised my concerns at the end. This will be picked up separately by another senior management team member. I am more settled now that I have had the meeting and the process that I trust, can move on. Interestingly, just before I went in, the girl came down to my area with her copy of her statement and was showing people it, she was swinging her pass on a long lanyard and then handed her papers to the manager who held her meeting! I immediately told my manager and said to him that if you give someone enough rope, they will hang themselves. Also advised that all my teams were interviewed individually. Let's see what today brings..... I have asked for the harassment to be looked at under formal disciplinary and conduct policy, so hope this starts today.

Keep us updated, as following with interest since its clear your the victim of vexatious claims and harassment and not just breach of confidentiality. I feel this Girl is someone who thinks shes popular and is above the law/company rules and thinks she can do and get away with anything she wants. She is clearly very naive and as you said, "Give someone enough rope and they will hang themselves"!

I will certainly keep you updated, however, she went on holiday today, so outcome of her grievance will have to be delivered to her first, prior to me being told and then she will be dealt with in the other matter separately by another manager who still has to be assigned. Thanks for being here!

Doesn't the HAWSAW act come in to this also? Your employer is supposed to keep you safe at work as far as practicably possible. That has to include all manner of health and well being. Someone correct me if im wrong.

Yes, as advised already write everything down. I have been through a court tribunal thing for bullying at work, and the judge wanted to know more about how it affected me outside of work than anything else. So make sure you write down all your feelings and how it affects you. Xx
