  • Reasonable adjustments

    Hi there.

    i am hoping that someone could point me in the right direction.

    i work for a very large employer in and i know find myself in a position where I need a reasonable adjustment because of a disability.

    I am being told that I have to “apply” for reasonable adjustments even though I know I am entitled to do this.
    Is the onus on the employer to explore the reasonable adjustment?
    They are clearly aware of my disability and I was of an assumption it would be best to have a collaborative approach but it seems my manager thinks I should be going to them begging for it, even though I’ve already made a formal
    request.

    There is a lot of sickness and positions when people have left, roles have not been recruited for and this has already been used as a reason to put me off from asking on the basis of productivity
    Can employer do this as well?

    I appreciate any advice or direction given.

    Hello, just a few questions if you don't mind, just so anyone reading this knows where you are with is so far.

    What is the disability you require adjustments for?

    ​Have you officially made your employer aware of your disability? If so how and when?

    ​​​​​​What sort of adjustments do you feel you need?

    Can your employer refer you for an occupational health assessment?

    If you make your employer aware of a disability they have a legal obligation to support you in the workplace and ensure you're not disadvantaged. Ask for a meeting with the appropriate person to discuss it. Think about what adjustments would benefit you, and try to keep them 'reasonable', they may be more likely to accept any changes if they don't disrupt things too much. They don't have to agree to any requests, but they will need to have considered them and have a valid reason as to why they don't. A lot of employers won't offer up adjustments for many reasons, but I doubt they consider them selves experts on this. That's why I asked about access to occupational health.

      Hi there.
      Apologies for the delay in response.

      I have a hyperkinetic disorder and I have to take medication for it.
      I have asked that I finish work at a certain time because I cannot take the medication after a certain time without it affecting my sleep as I work shifts.

      My employer was made aware of the situation last year
      and Occupational Health are involved although they have no idea how to manage the situation it has been left open.
      Im supposed to be monitored and to have welfare meetings which have not happened.
      My employer initially was ok with a temporary arrangement but now caveats have been added on for their convenience and no clarity has been given when asked despite it initially being put in writing.
      Due to the nature of my job I am told that staffing levels are a problem late at night however there are 200 other people doing the same role as I do and it’s clearly an excuse because sickness can be high late in the day.

      i believe what I’m asking for is reasonable, and there are also
      a few other people who are not classed as having a disability but don’t work past a certain time at my location which I believe is discriminatory towards myself.
      i have no business knowing what issues they have, i just wish to be treated the same as my colleagues have been.

        The further information provided is helpful however you have stated that you have asked to finish work at a certain time, how much less does this mean you are working on your shift e.g. is you shift 7 hours and you want to leave 2 hours early?

        What have you done about putting your request of reasonable adjustments in writing to your employer and arranging a meeting with them particularly if follow-up welfare meetings have not taken place?

        Would working on a different shift be more helpful to your condition and when you need to take your medication? If so have you asked that as a consideration of a reasonable adjustment?
