  • Employer Saying I Quit..

    My new boss (J) directly over me is horrible, he started a month ago and little things have started to build up. on Friday we had a small disagreement over the phone (I drive semi's for local routes) and I hung up on him.
    I went back to the warehouse as usual and left for the weekend. Sunday I spoke to his boss, (S) and said I didn't know if I could work with J. S asked if I would turn in my uniform and I said "okay."
    I later wrote a text to S saying I thought about it and J is the boss and I'm willing to work with him and follow his direction.
    S came back saying I quit. I never quit! I said I would turn in my uniform, but only meant it, IF I decided to quit. I explained this to S via text and told him I'd be into work on Monday. He never responded. I went to work on Monday and J came in saying "you need to leave!" I said, "okay, guess I'm fired." J waits a few seconds and says, "no, you quit."
    So now it's my word against theirs. I never said I quit or resigned.
    should I contact HR and explain or should I just file for unemployment. I was with this company for 2 years.

      Okay, so this is a UK forum and our employment laws are very different.

      From what I know of your employment laws it is going to be about you arguing that by telling you to turn in your uniform that the employer fired you.

      You didn't actually say that you were resigning, but you did say you can't work for your boss to their boss, so they will argue you didn't use the word 'resign' or 'quit,' but by saying you can't work for the boss is as much as saying it.

      Do you think there is any point in contacting HR? What will that achieve? You may be reinstated and then the boss and his boss will find some other reason to either fire you or will make life hard to the point you do resign.

      Personally I would file for unemployment and hope that they do not contest it.
