  • forced to sign disciplinary

    a colleague of mine (L) started a grievance against our manager, (T)......as i had 'proof' i was brought into it along with another member of staff. (S)
    i have now been told there are grounds for disciplinary proceedings if i dont sign a form,
    .... it was my manager (T) that started the work group chat with myself and 1 other member of staff (S). moaning about our colleague (L) we barely said anything, all i said was (T) was the manager and im sure she would do whats right....
    we had individual meeting with HR ..... ive spoken to ACAS and they said i could start another grievence...as i said i wasnt bothered about the result of my colleagues (L) outcome.. i just wanted to know why my manager (T) tells staff to distrust me.....but i dont want all the drama.......

    i then find out (s) who is the mouthy one lol hasnt received a letter/diciplinary. how the heck she ALWAYS gets away with things.....

    HR have said the messages shouldnt have been discussed and were confidential.

    please please any advice. x

    Sorry I am very confused by your post.

    A colleague has raised a grievance about your manager, presumably about the content of the messages in the WhatsApp group. As a person in that group you have been spoken to about it as part of the investigation into the grievance. As part of the investigation into the grievance have they now decided there is the potential for disciplinary proceedings against you because of things you have stated in the WhatsApp chat?

    If I have got this wrong please can you correct my understanding.

      its so hard to explain.

      a colleague (named L) started a grievance with HR questioning her hours/shifts which our manager (T) sorts out

      our manager (T) had no idea about this grievance, as we were told HR were at the time compiling info.

      our manager (T) started the works group chat with just us 3 . ......myself... manager and (S) and (T)

      myself..... (L) and (S) all individually had meeting with HR and explained things, their main question to me was why did i feel the need to give the info to (L).....i said because i was told by (L) and (S) that my manager was telling staff not to trust me,,,,,so i thought ,,,right lets now get EVERYTHING out in the open and finally find truth,

      it seems i breached data protection and confidentiality..

      i only said in whatsapp group...."as (T) was manager im sure she would do what is best..."

      it was my manager doing all the texting.

      im so upset today....yet again my colleague (S) who told HR a heck of a lot of things thats gone on.....has no letter and nothing to worry about.

      im trying to see if i can look at work employee handbook, but im so sure we never had one. until recently.

      i cant afford a solicitor as im off work on sick leave and dont have the strength or confidence to go thro drama, as i suffer PTSD/depression.

      i just hate myself....seems i cant do anything right these days.

        Sorry to hear that your are suffering PTSD/depression and I understand this situation at work will not be helping.

        How long have you been employed with the company?

        Going back to your first post what form are they asking you to sign which they have said if you do not then you will be facing a disciplinary?

        When you had the individual meeting with HR what was is about? The content of what was in the WhatsApp chat or something else?

        Why do they think you have breached data protection and confidentiality?

          sorry ive not replied.....

          its all a bit worrying for me....been a tough year, then this happens.

          again thank you for your reply.

          i ve been with the company 5 yrs as self employed....but january this year we all became employed.....ive spoke to acas...again trying to explain... my employers have been clever im sure. .but for some reason they amalgamated with another similiar company that was linked to them.

          so new contract from jan this year.


          they have sent me an email stating the outcome.....and this email i have to sign to say i agree with the outcome.

          i had a zoom call with HR... as colleague (L) mentioned me in her grievance that SHE brought up about her losing hours.
          in the meeting, was myself and one lady from HR and another man who apparently was taking ,minutes/notes.

          i explained i didnt really want to be part of it all.....HR just asked me how/why/when it all started, and what did i want to get out of the meeting.....which i said was, why werent staff all treated the same, and why was my manager (T) saying to others NOT to trust me.

          it seems i discussed confidential information.....
          myself and other colleague (S) spoke to (L) about how our manager (T) was being underhanded.

          looking at my contract.... it says....not to divulge any confidential or sensitive info regarding the business....

          the part they have me is........not to divulge info, eg, phone numbers etc, relating to other employees.

          so yep seems im in the wrong for speaking to (L) about how our manager set up a whatsapp group including me and (S) saying (L) pos wasnt keeping her job.

          1....why havent i been told why im not to be trusted
          2....why have i been disciplined and NOT (S)
          3....how do i really know my manager has been disciplined....as we all know she has got away with underhanded things before by the company. ever manager told us they would keep managers over staff.


          again ant help would be amazing

            So was the meeting you attended:

            Either

            1. A formal disciplinary meeting, in that you were sent a letter being asked to attend a disciplinary meeting and the letter gave details of what you had done wrong, what might be the outcome if disciplinary action is to be taken against you and the right to be accompanied.

            OR

            2. A meeting as part of the investigation into a grievance raised by another colleague for which you are being asked to confirm that the notes taken of your meeting are accurate/

            In a general answer about other people being disciplined this is confidential information and you should not be told who, if anyone, has been disciplined as part of what happened.

            If you want to understand why you are being told you cannot be trusted then you may need to speak to HR and ask them to explain.

              afternoon.

              2........the meeting was via zoom which i did from home.....i was asked to do this as i was mentioned in my colleague (L) grievance letter she sent HR, then HR decided to investigate once they had everyones side.

              i think i will obviously be in trouble it seems for giving my colleague (L) the written proof......but why, yet again has my other colleague (S) had nothing back on her ...she was the one who told (L) i had proof and about what was said, and suggested i bring it out in the open.

              it states in the outcome email that .......messages sent between myself (T) and (S) were unprofessional and we discussed confidential info. so why just me having a discipline

              i also know that yesterday my manager (T) discussed another member of staff when she shouldnt have...

              again i still havent heard why i cant be trusted.....im nervous, but wondering if i should do another grievance....as i feel ive been treated unfairly.

                If you feel you have been treated unfairly then you do have the option to raise a grievance.
