HI can anyone help. I work in retail and a customer complained to head office about the staff. We have all gone through the interview process of asking questions about the so called complaint. This has now lead to the hearing to discuss the outcome, however I have also received my colleagues documentation from there interview? Can any confirm if this is correct practice to receive this as its the same complaint or has there been a breach of confidentiality?

It is correct that a person against whom disciplinary action is to be taken is provided the material resulting from the investigation. Take a look at the ACAS code: https://www.acas.org.uk/acas-code-of...nce-proceduresLawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. If a fact finding investigation leads to you being called to a disciplinary meeting then yes, all the evidence needs to be provided to you by the company, so that you can then present your case at the meeting, knowing the facts that the company has and upon which it will make a decision on what if any disciplinary action will be taken. If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com
