  • Fact find

    HI can anyone help. I work in retail and a customer complained to head office about the staff. We have all gone through the interview process of asking questions about the so called complaint. This has now lead to the hearing to discuss the outcome, however I have also received my colleagues documentation from there interview? Can any confirm if this is correct practice to receive this as its the same complaint or has there been a breach of confidentiality?

      Both me and colleague gave information regards to the complaint, Which was made about the staff in store which included me. I have received all his fact find details with all his answers, is this right?

        It is correct that a person against whom disciplinary action is to be taken is provided the material resulting from the investigation. Take a look at the ACAS code: https://www.acas.org.uk/acas-code-of...nce-procedures

          Even to have the others involved documentation including the questions, answers and where the potential non alignment to the facts and what the colleague answers were? So when I go to my hearing is it right that I have my documents for my fact finding including his?

            If a fact finding investigation leads to you being called to a disciplinary meeting then yes, all the evidence needs to be provided to you by the company, so that you can then present your case at the meeting, knowing the facts that the company has and upon which it will make a decision on what if any disciplinary action will be taken.
