  • Need legal advice for resignation during investigation

    Hi all , I work as a temp staff for an international bank for almost 2 months. I'm under investigation for data breach as I sent my personal notes to my personal email for revision purposes which contained confidential info . It was negligence on my part . However the document did not go through as I received an email saying I breach the policy as there was confidential info so the document got blocked by the company's firewall . I didn't mean to do it on purpose. I should have been more careful . Worst case I will be terminated if investigation. Finds I'm at fault for this .

    However to be honest this job from the beginning was not suitable for me as I had no financial background prior to joining and wanted to seek out for another job that is more suitable .

    Is it a good idea to resign while being under investigation ? I feel really burned out by the nature of the job and I'm only a temp staff wanting to move to something else that suits me more as I have already have another job offer on hand. n I'm scared when I leave they may press charges but I work there for such a short period so im not sure what to think. please advice

    ULA will be able to advise better than I regards the employment side.

    They will not press charges as a data breach would be a civil matter not criminal. The likely outcome of the investigation would be that the breach amounted to Gross Misconduct and you'd be dismissed.

    I think if you resign you will be okay and can move on to the new job you have been offered.

        Just to add that resignation is not an admission of anything and you can give your reasons that you are not from a financial background which has made the job stressful causing 'burn out.'

          I so wish I had found this site and asked this question a month ago!

          My son was dismissed for gross misconduct, he had a week between suspension and dismissal where he asked if he should just resign as he was concerned about future employment. But because they gave being retrained and continuing to work there as a possible outcome we decided not to as we were unsure if resigning was a further admission of guilt even tho he'd already admitted to what he did so it made absolutely no sense to think that I know.

          Honestly if we could rewind everything I would definitely have advised him to resign. From what you've said resignation sounds like the best option.
