    Hello,
    I am starting an e-commerce brand (Watch/ Accessories) which has no conflict with my current job (Automotive) however in my contract it states the below regarding intellectual property. I want to make sure this doesn’t break my work contract or would entitle them to own any of the business legally.Apologies if this is a really basic question, I just want to be sure before launching the business whilst employed:

    “Intellectual property rights” means patents, copyright, database right, registered and unregistered design rights, trademarks, utility models, plant variety rights and other intellectual property rights throughout the world, application for registrations of any of the same, confidential information and know how, whether in all cases registered or unregistered.

    The employee may make or create Intellectual Property Rights in the course of his/ her duties and has a special obligation to further the interest of the Employer’s business in this respect.

    Where the employee makes or creates any Intellectual Property Rights that may be of benefit to the Employer, he/she shall inform the Employer forthwith in writing and such Rights shall be owned absolutely by the employer so far as the law allows. The employee shall enter all documents and do all things necessary to ensure such ownership. The employee waives all moral rights therein.

    The employee irrevocably authorises the Employer to appoint a person to execute any documents and to do everything necessary to effect his/her obligations under this clause on his/ her behalf.

    As long as you are conducting your own business in your own time and not in time while being paid by the employer your IP is yours being a completely different sector to the employer.
