          I got this email from the County Court 10 minutes ago!
          (IN RESPONSE TO AN EMAIL I SENT THEM ADVISING THEM OF THE 28 DAY EXTENSION SHOOSMITHS GRANTED ME.. I have it in writing)

          This has been noted on the court file; however we have not been informed by the claimant.

          CONCLUSION

          Its just as well I did inform the County Court of my Court date 28 day extension. In spite of Shoosmiths solicitors telling me not to email the Court (that they would inform the Court of my extension), they didn't! And I believe that would have been my goose cooked!

            Hi It is the defendant who informs the court, so if Shoosmiths did tell you they would inform the court then that was wrong of them.

            Agreement extending the period for filing a defence

            15.5

            (1) The defendant and the claimant may agree that the period for filing a defence specified in rule 15.4 shall be extended by up to 28 days.

            (2) Where the defendant and the claimant agree to extend the period for filing a defence, the defendant must notify the court in writing.

              Hi Amethyst, yeah, the costs weren't itemised. Silly me didn't realise the cost of the court hearing and extra fees would be charged to my account . My extension ends December 6th.

              No sign of any CCA or CPR documentation yet. So far so good!

                Shoosmiths did tell me not to inform the court. They said they would do it. Okay it was the girl who answers the phone in their office, but she should know. Oh, well .. I scrapped through that one by the skin of my teeth and your good advice! :biggrin1:

                  HELLO ALL :mullet:, :help:

                  Well so far no news is good news. No sign of any CPR or CCA documents.

                  My defence deadline is 6th December so am thinking I should be starting to put my defence together. I know earlier in this thread someone kindly put a list of templates for this purpose. I'm trying to put together in my head what to do/ say.

                  My idea of what I've to do goes like this:

                  Obviously there is the Court form which I need to fill in. Is it just that last page of the court forms I have to fill in and send back? It has N9B(SDT) in the bottom left hand corner and says Defence and Counterclaim (specified amount) at the top. I assume I leave the section 4 free as I do not wish to make a Counterclaim, and just fill in sections 1, 2, 3 and 5, outlining my defence. As regards section 3 my Defence, I suppose I say see the included form and add one of your templates which I have personalised.

                  I'm guessing I don't fill in N9A (SDT), it says ADMISSION at the top!

                  And basically, my defence is that Shoosmiths / Cabot have failed to allow me to inspect CCA & CPR documents, despite my letters and phone calls requesting inspection. Do I need to ring/ email again about these forms? (I've already sent letters, emailed and phoned them, then emailed them again itemising my attempts for the record, so I guess not .. ?)

                  And lastly I need to copy my CCA &CPR Request letters and print off copies of my emails to send off with it all ..

                  My main question is what have I missed?
                  Also, any tips for filling in the templates?

                            so have just taken a look back.
                            Complete N9B only. No Counter Claim.

                            You have non compliance with CCA request thus debt cannot be enforced
                            Failure to comply with CPR 31.14 gets a mention too.
                            Put a draft together post it here and we can go through it with you.
                            Look at others threads with defences it will give you and idea of content/wording and format.
                            You must know exactly the points you make in your defence mean the judge will ask questions.
