    Hi Nem when I phoned this afternoon the woman told me that the judge will look at it and say if they will let them have more time. I find this so hard to believe as they have caused delays every time they have had to send papers back to court. They brought this action not me surely since they started this back in nov/dec they should have all the info they needed to carry on and send to the courts. This last lot of papers were sent by my local court in the beginning of feb and I sent my things back so why have they left it until today the last day to ask for longer im so friking mad. If the judge lets them have more time theres no justice I feel he should say no to it I don't see how he can in all honesty let this go on sorry to go on I,m just so angry about it

      Hopefully the judge will see the further extension as unfair given the time the claimant has already had to file the documents.

        :beagle2222::beagle2222:Hi Nem thank you for the reply. I have phoned the court again to day as I had such a bee in my bonnet over there delaying tack ticks and spoke to a really nice lady. She told me she had sorted this herself as they requested it not to go in front of a judge (I wonder why). She said she has sent me a letter telling me they have asked for a 30 day extension to get there stuff together (why) they have had since December to do this. Ant way she is writing to me and letting me know that I have seven days to object to this and ask for there action against me to be struck out. Would some one be kind enough to help me word a very good letter to the court as to why it should be struck out. Thank you in advance for any help I would like to add that when I sent my defence I had put in there that this action was brought after the stb time limit and I would be seeking compensation from them over there unreasonable behaviour in all of this apart from wasting valuable court time .

          If you put the " events " in chronological order for me I'll draft a letter round them over the weekend if you wish.

                Hi Nem I have been through paper work and it all started on the28th nov 2014 when cabot first filed there court papers On the 18th dec 2014 the court sent out papers for me to fill in questionnaire and it had to be returned by the 5th jan 2015. mine were back in court by 30th dec 2014. cabots had not sent theres back and asked for an extension of time to do so this was asked for on the very last day. this was then allocated to my local court and on the 13th feb 2015 I recived papers informing me that both sides had until the 9th april to send back to the court and to each other our defence and any other info we intended to rely on. And true to form they have now asked for a 30 day extension to get there so called evidence together. I think they are taking the micky out of the court time and mine .I hope this halps to start with x

                    Can not think of any thing else only that they have not come up with any thing to support there claim nothing at all so just wondering if they will try to invent anything now. Thank you once again for all your help Anne x

                      :tongue2:I have worked it out that in nearly 6 months they are still asking for more time. If in all this time they are not ready and bearing in mind they are the one,s who brought this to court surly the court will not allow this to go on bearing this is only a stb claim not a murder case lol just a thought Annie

                        The Defendant Holds that the matter is Statute Barred under section 5 Limitation Act 1980.
                        Application for Extension of Time to File Documents.
                        This application by Reston Solicitors on behalf of Cabot Financial is contested for the following reasons.

                        I am a litigant in person defending this claim:
                        1. On 28th. November 2014 Cabot issued Claim No.......................:.
                        2. On .......................: I requested sight of documents mentioned in the statement of claim under CPR 31.14, the claimant has failed to comply. A copy of the claimants answer to this request is attached (Ref: Cabot/Reston A.)
                        3.On ........................: I sent Cabot a Request under Sect. 77 -79 of CCA 1974 Cabot has failed to comply with this request: (A copy of Cabot's response is attached: ( Ref: Cabot/Reston B).
                        3.On 18th. December 2014 I received the questionnaire from the court, and returned the completed form to the court o 30th. December 2014.
                        4. On ...........................: I became aware that Cabot/Reston had not filed their documents and had made a "last minute" application for more time.
                        5. On 13th February 2015 I received notice of the allocation of the claim to my local court.
                        6. I was advised that both parties must file documents and provide copies to all parties by 9th. April 2015.
                        7. On.............I filed my defence and all relevant documents with the court and provided copies to Cabot Reston.
                        8. I have been made aware that once again Cabot/Reston are seeking a further 30 day extension to provide " evidence" relating to the alleged debt.
                        9. I respectfully request that the court disallows Cabot/Reston's application as a litigant in person the time, cost and stress caused to me is now excessive. Cabot Reston has had more than reasonable time to produce the document to support their claim.
                        10. I respectfully request the court to strike out the claim on the grounds given above.

                                Hi everyone well after all this time cabot /wright Hassall have failed to return doc,s to court which should have been back by the 7may as they asked for longer to do so. Although I have writtern to court and asked for there case to be struck out I now have to fill in n244 and ask for them to strike out there claim for non compliance of court order I could really do with some help on how to fill this in could some one please urgently help in this matter. Thanks in advance for any info :tinysmile_hmm_t2:
