So, a credit account opened without a signed agreement? I don't think so. All lenders must supply and receive a signed agreement prior to opening an account. This also give the customer a cooling off period during which you can cancel the application without penalty.
They are trying to tie you in knots with legal stuff hoping you won't know the difference. Personally I would challenge them, no legal signed agreement, no payments, period. If they can prove it is your debt let them do so in court or back-off. If you "know" it's not your debt, and can prove it, you may well be able to pursue them for harassment etc.
