    Unfortunately my book keeping was no so good back in those days - I'm trying to contest that I have settled the debt with the original lender - I just don't have the paperwork to back that up.

    I guess I need to get back to the original lender and try to get a copy of this? Given that it took Cabot nearly 8 months to come up with an agreement I wonder how long it will take to get any settlement paperwork out of these guys. I did get a default notice (I think) but I settled this debt not long after.

    I settled all this around 2002 so it was a surprise when Cabot got in touch in 2005.

      Yes a Subject access request to the original creditor would be a good idea, also you probably paid the debt by debit/credit card, i would check all your bank and card statements from around that period and/or ask for copies of such statements from the bank and card company.

      Also if your last payment (or in your case full settlement) was in 2002, then its been well over 6 years since you last paid and acknowledged the debt - so any amount they claim is still owed would be statuted barred anyway. But lets see what the subject access request comes up with.

      Also when you say settled do you mean paid back in full or just in part as a full and final settlement offer?

      Have you checked you credit file to see if they have recorded any adverse data on it? - As you maybe able to make a claim against them if they have and if your able to prove via the SAR that the debt was indeed settled - The original Default from when you received the Default Notice will have fallen of your credit file after 6 years, so these lot should not be putting another one on your file anyway.
