    Can this CCJ be set aside

    Hi everyone

    2 years ago I have found a CCJ from Calbot on my credit report, it went to court 6 months before finding it (I know, I should check my credit report more often)...I have phoned them and agreed to pay them monthly a small amount and I have been paying for the last 2 years, but I really feel it should be set aside because I have never received any paperwork as I wasn't living at that address anymore. Is there a chance that the judge would set it aside or will the judge see it as an admission as I've been paying it for the last 2 years. Many thanks.

    No, you should have applied two years ago when you found out if you had grounds to set aside and by paying it you have admitted that you owe it, so no judge is going to set it aside.

    Acknowledge Claim - within 14 days from Service

    Defend Claim - within 28 days from Service (IF you acknowledged in time)

    If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
