  • I started a Claim via MCOL but communication too slow

    Hello everyone,

I hope someone can provide some insight into my situation regarding a small claims case I’ve initiated. Here are the key details:
    1. Case Overview: I filed a small claims case against a seller, The claim was officially issued
    2. Current Status: According to the Money Claim Online (MCOL) portal, the defendant filed a defense and a Directions Questionnaire (DQ) was sent to him on the same day. However, I have not received my DQ yet. There is no details if I was sent one desbate defender one is on there
    3. Communication with the Court:
      • I have sent several emails to the court, including the Claim Responses Team received automated responses stating that I should expect a reply within 10 days.
      • I have called the court multiple times, but after holding for about 30 minutes, the calls get cut off.
      • The last email I sent to the court regarding this issue was last week, but I still haven't received a substantive response.
    4. Actions Taken:
      • I’ve ensured that all my emails include the claim number and relevant details.
      • I’ve received automated replies confirming receipt of my emails but no follow-up or specific guidance.

    Questions:
    1. Is it normal for there to be such a delay in receiving a DQ, especially if the defendant has already received theirs?
    2. Given that I have received automated responses but no substantive reply, should I be worried about any deadlines or missing documents?
    3. Are there any additional steps I can take to ensure I receive my DQ and continue with my case without further delay?

Thank you in advance for any advice or suggestions you can provide.

    Welcome to LB

    a) Is it normal for there to be such a delay in receiving a DQ, especially if the defendant has already received theirs?

You haven't put any dates. Normally parties receive them at the same time.

    b) Given that I have received automated responses but no substantive reply, should I be worried about any deadlines or missing documents?

You need to keep on top of the case, difficult if the Court aren't doing what they are supposed to do.

    c) Are there any additional steps I can take to ensure I receive my DQ and continue with my case without further delay?

Use the following DQ - https://www.gov.uk/government/public...l-claims-track

    Guide to help - https://legalbeagles.info/library/gu...uestionnaire//

Puts you back on track, remember to send a copy to the other party.

The court service is funded* by the government.

      * "funded" is a euphemism, meaning starved of resources. It has been thus for several years.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

Litigants in Person should download and read the Judiciary's handbook for litigants in person: https://www.judiciary.uk/wp-content/..._in_Person.pdf

I'm not passing judgement on 'Government / funding', I could, but 4th July, the people will speak.
