I hope someone can provide some insight into my situation regarding a small claims case I’ve initiated. Here are the key details:
- Case Overview: I filed a small claims case against a seller, The claim was officially issued
- Current Status: According to the Money Claim Online (MCOL) portal, the defendant filed a defense and a Directions Questionnaire (DQ) was sent to him on the same day. However, I have not received my DQ yet. There is no details if I was sent one desbate defender one is on there
- Communication with the Court:
- I have sent several emails to the court, including the Claim Responses Team received automated responses stating that I should expect a reply within 10 days.
- I have called the court multiple times, but after holding for about 30 minutes, the calls get cut off.
- The last email I sent to the court regarding this issue was last week, but I still haven't received a substantive response.
- Actions Taken:
- I’ve ensured that all my emails include the claim number and relevant details.
- I’ve received automated replies confirming receipt of my emails but no follow-up or specific guidance.
Questions:
- Is it normal for there to be such a delay in receiving a DQ, especially if the defendant has already received theirs?
- Given that I have received automated responses but no substantive reply, should I be worried about any deadlines or missing documents?
- Are there any additional steps I can take to ensure I receive my DQ and continue with my case without further delay?
