In my opinion the thing that the bank will take most seriously is its lawyers' assessment of the case. You need to put forward a strong case, and to show that you are ready, willing and able to take it to court.

Having lawyers instructed on a CFA and having adverse costs insurance in place will help show that you are able to take it all the way.
