If you put affordability complaints in and they said they acted responsibly, but you disagree you should complain to the Financial Ombudsman Service plus inform the Claimant you have immediately.

Part of the complaint form with FOS will ask if you are engaged in legal proceedings.

I did not mediate. The times they set were inconvenient. When I spoke to the mediation staff they advised I would get another opputunity before it goes to court to do so and I did not.

i have not yet put an affordibility complaint in, however I have signed up with a company a few days ago who are doing this on my behalf with a number of old payday loans I had therefore by the time it goes to court I will have submitted them but unsure if that will be relevant or be relevant to the court etc.. any ideas ?

Hi yes the date is the 11th April - 14 days to send documents / witness statements . Moriarty Law have sent me their witness statement, loan agreement , statement of account ( which does not look correct) , final demand letter dated months ago and a notice pursuant to rule. This pack is dated 27th March, but I never received till the 29th
i send a affordibility complaint last week to mr lender.

I'm not sure I want to ask this but...

Have you submitted your Witness Statement?

                    Comment

                    • Yes I submitted one - is your concern what my witness statement consists of or that it might not have been timely?

                      Comment

                      • Think it's the timely thing ( quite a few people don't see the ws info on the second page of the hearing notification letter and fail to do it )

now one you have theirs and some of the documents - is there still a defence ? What are the statement issues ? Is the agreement correct ? ( does it make sense - last Mr Lender one I saw simply made no sense mathematically) is there a default notice ? Etc

You can add a supplementary witness statement if need be

                              • As they have offered to recall this from MMF - my question is can they do this even though MMF assigned Moriarty Law who have now taken me to court.
