    OK, so now the debt is no longer being handled by Restons, but by Arrow Global. They have written to me and sent a copy of the agreement statements and notice of assignment from Idem Capital Securities Limited to Arrow Global.

    In this letter, they have stated that I don't have any defence with any reasonable prospects of success, should the matter go to trial. And they want to come to some form of settlement instead of proceeding to trial to save me further costs.

    So what do I do in this case?

    If it seems in my best interests to come to some sort of settlement, is there a template I can use to write to them?

    I was about to try to compose a letter to them, but was not sure on what to put in it.

      as they always state in their letters to unsettle you. and who says the agreement is enforceable? not them I hope!

        As far as I can see, when Restons were dealing with this debt they took me to court but a stay was put in place and now its been handed over(?) to Arrow instead and I am guessing that their legal team feel my defence wont hold up in court.

          well they may chance their luck - tossers/ se what other say it is the weekend look in to-morrow etc for the peeps to suggest for you do not give in on silly hearsay or a last ditch attempt to resurrect a claim (cost them monies to do so)

                They will need to file a notice of change of solicitors with the court before they can do anything.

                The documents that Arrow have just sent you, do they correspond with the documents you eventually got from Newday under the SAR.

                So they have sent the agreement , statements and notice of assignment ( from IDEM ? to Arrow ) - how did the debt get to IDEM from Newday ? ( they will need that assignment as well )

                This was opened in 2014 and defaulted in 2015 wasn't it, so not that old. Assume it was an online application so the agreement is pretty generic - is it the correct one as far as you recall though ? for the right card ( Aqua? ) at the right rate etc ? ( did you get a copy with the SAR information ?)

                Now is your opportunity to go through your defence and see what applies and what they have evidenced and what defence you have remaining and then consider your position from there.
