Danske Bank lost a repossession case for a farm and a dwelling in the High Court in Northern Ireland on 12th June. The argument was one on basis that lending was asset based. £750000 lent on annual income of 6k. Although it has no binding effect elsewhere in Uk, it is a significant victory under s140a of theCCA. It is also believed to be the first case to be won for asset based lending in UK. Further information can be got on Facebook.

I misquoted date. Case was heard Monday 6th. June. It was a clients of mine which is why I am aware of result. The case has been adjourned to September for clients affordability to be independent ly calculated. I expect case to be published soon thereafter.
