Danske Bank lost a repossession case for a farm and a dwelling in the High Court in Northern Ireland on 12th June. The argument was one on basis that lending was asset based. £750000 lent on annual income of 6k. Although it has no binding effect elsewhere in Uk, it is a significant victory under s140a of theCCA. Acknowledge Claim - within 14 days from Service
Defend Claim - within 28 days from Service (IF you acknowledged in time)
If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
