Re: County court claim form from lowell portfoilo

    Hi Farny,

My suggestion as referred to previously an attempt to stop the claim now IF you want do try this.

    Lowell Solicitors Ltd
    Address as on claim form

    Date..................................

    Ref: CC Claim No.......................:

    Sir/ Madam,

I am in receipt of the above mentioned claim issued on behalf of Lowell Portfolio and have responded to the court and stated my intention to defend the claim in full.

I have taken the opportunity to research the alleged debt and have concluded that any such alleged debt is and was when this claim was issued Statute Barred no payment or written acknowledgment to the alleged debt in more than 6 years.

Given the information above I will not make any payment or offer of payment now or in the future.

I suggest that Lowell Solicitors now refers this matter to its " client" advising them to discontinue/withdraw this claim in the interest of saving cost and court time.

I am sure both Lowell Portfolio and Lowell Solicitors are fully aware that the onus of providing unequivocal proof that the alleged debt is not so barred fall entirely upon Lowell Portfolio.

Take note if Lowell Portfolio decides to continue the claim it will be robustly defended.

    Yours etc.

If you send this also make a CCA request to Lowell Portfolio.
