ccj different money

Hi all
I received a letter today saying i had a ccj. Basically a payday lender has linked my name to someone and the courts have agreed that i am that person and there amended the ccj to include my name on the claim. I phoned up the number on the paper work and they basically said you go by 2 names thats why we have put your name on the judgement. I asked why i didnt get a summons letter as i would have defended myself to which they replied we did send it to you in your other name. I told them i dont go by that name so i wouldn't open a letter which is not addressed to me. Apologies if im not making sense im just fuming that they can be allowed to do that. CAN ANYONE HELP PLEASE

Excuse my ignorance but can I ask? Do you need to be credit checked and give a date of birth to get a payday loan

No I don't use an alias, and don't they need to credit check you and all that before giving you credit

Hiya,

The CCJ was awarded against Mr X at your address. YOu don't know who Mr X is.

The payday lender then told the court that you, Mr Y , are actually Mr X, and the court amended the judgement to Mr Y ? and you now have a CCJ against you.

You have never had a loan with the claimant company ?

Could someone have taken out a loan using your details ? have you checked your credit file ?

What did the payday lender use to evidence to the court you are the same person as Mr X ?

You'll need to apply to set aside the Judgment.

They seem to have made a link with my name to the other persons. I dont know what the link is. They also didnt send me summons in My proper name so if the summons for that other name came i wouldnt have even opened them i would have just binned or my partner would have. I rent a house so we do get a lot of letters addressed to the previous tenants hence if my name isnt on it i dont bother. I can however say i am not the person who owes the money and i dont know what made them link him up with me. They were very dismissive when i tried to have a word with them so i dont know what to do besides try and get it set aside.

Can the courts just give you a ccj without even inviting you to defend yourself or let you prove your identity.

Can the courts just give you a ccj without even inviting you to defend yourself or let you prove your identity.

You will need to make an application to the court to set aside the default judgment against you. There is a fee of £255.00 for doing so.

Sounds like someone has been very persuasive here!

Suggestion Check credit reference file Experian/Equifax have 30 day free trials, Noddle if free online, there is a distinct possibility that and relevant link will show up.

Then you can start to work out what has happened, have you shared a house/flat with someone who could use your name and my have other personal information on you.

Yeah i shared a house with 2 other guys last year, they moved out and my missus moved in as we wanted the privacy.

I would suggest Mac that you put this as a Formal Complaint in writing by signed for post for security and checkable paper trail on can never be sure the e- mails will be getting to the right person.

Look up directors/ principal solicitor and go to the top it makes for quicker action and better results.
