    hi nem here is the prove it letter I sent.

    dear sir/madam

    You have contacted me regarding the account with the above reference number, which you claim is owed by myself.
    I would point out that I have no knowledge of any such debt being owed to jd Williams.

    I am familiar with the Consumer Credit Source book of the financial conduct authority (FCA) which states the following rules:

    A firm must suspend any steps it takes or its agents takes in the recovery of a debt from a customer where the customer disputes the debt on valid grounds or what may be valid grounds
    7.14.1
    Where a customer disputes a debt on valid grounds or what may be valid grounds, the firm must investigate the dispute and provide details of the debt to the customer in a timely manner 7.14.3
    A firm must provide a customer with information on the outcome of its investigations into a debt which the customer disputed on valid grounds. 7.14.5

    Where a customer disputes a debt and the firm seeking to recover the debt is not the lender or the owner, the firm must :

    1) Pass the information provided by the customer to the lender or the owner or
    2) If the firm has authority from the lender or owner to investigate a dispute it must notify the lender or owner of the outcome of the investigation 7.14.6

    In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive and or unfair methods furthermore, ignoring and or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

    I would ask that no further contact be made concerning the above account unless you can provide evidence as to my liability for the debt in question.
    I await your written confirmation that this matter is now closed , otherwise I will have no option but to make a complaint to the Trading Standards department and consider informing the Fca of your actions.
    If appropriate I will also take this matter forward as a complaint to the financial ombudsman service and information commissioners office.

      Well I can see no conditions, fees or timescales there, someone I suspect has no idea what the FCA Consumer Credit Source Book is.
      Send the " new " CCA to Andrew Bartle ad comment on the stupid letter at the same time,

          I would point out that the writer of the letter clearly has no Knowledge of the FCA CC Source
          Books as no terms., timescales of fees have been mentioned in your letter.

          Please confirm that Lowell has in its possession a copy of the requested Consumer Credit Act 1974 Regulated Agreement
          and you require the agreement within the 12 + 2 Working Days Statutory timescale or their written confirmation that they
          do not have the agreement and the file is closed.

              I suspect that the person who replied just used a template letter , possibly from the letter before but who knows , that they use when getting one of those silly get out of debt free letters that ask for xyz and say they will charge fees for this that and the other
              They then sign it
              NW of the family HC

              They make me chuckle (unlike the chuckle brothers who make me want to slit my wrists)

                Thanks nwhc they do cuffuffle my little brain it doesn't take a lot lol. I'm hoping I can stall them another few months until August at least haha what do u think r my chances lol ??

                    [MENTION=55034]nemesis45[/MENTION]. Well this is still going on lol last week I had two constituted credit agreements from Lowell. Both same credit agreement number but different addresses. Both old addresses of mine. Although one of them is wrong. No signature. No this drops off my file on the 10th of August and I'm convinced it's statue barred. What do I do next ?? Xxx

                        Please post up copies of both agreements after removing your personal information we can then look at them to see if they are compliant.

                        Recons must have your name and address as it was at the opening of the account., same for the creditor + the Ts and C's at opening and closure of the account.

                        If you have a problem posting the documents I'm sure [MENTION=49370]Kati[/MENTION] will be able to assist.

                                take the photos and add them as attachments in an email to me (usually has a little paperclip icon in the email)

                                to add a link, copy the website/page address at the top of the page (see highlighted bit in the attached screenshot) then paste it in to the email before sending
