[MENTION=55034]nemesis45[/MENTION] I had a jd Williams account which was opened 19/10/2007 in 2009 I sent them a cca request I think I sent it to cabot never heard anything. for about a year now ive been getting chasing letters from Lowell and fidelite. so a few weeks ago I sent Lowell a prove it letter. today I received a letter from Lowell saying they purchased from original lender in jan 2013, they are not acting as agents for the original creditor or any other third party, the account was opened 19/10/2007 and defaulted 10/08/2010. and they then go on to say the last payment on the account was on 30/09/2009 for £1 which was the £1 fee I sent with the cca request all those years ago. the default on my credit file says 10/08/2010 but surely its statue barred if they are saying my last payment was in 2009. and even then that was not meant for payment . they then go on to say they have requested a copy of my agreement together with copy statements of the account.during this time my account is on hold. and plus if they receive any correspondence from me they not b providing a response lol help lol

Hello Flicky.
Ok CCA request made, not complied with? Possibly Cabot which has allocated the statutory fee as a payment to the account correct?
Now Lowell say it bought the debt from the original creditor in Jan '13. The last payment is confirmed by Lowell as being £1 on 30/092009
approximately the same time of the CCA the CCA request.
Which of Lowell's " Trading Styles" is chasing this?
I think if challenged on statute barred status Lowell will claim the default date is the date of the start of the relevant 6 year period.
I think it's well worth another pound for a CCA request now, this time use a £1 postal order with " For Statutory Fee Only" written on
both sides, photo copy the PO and keep a copy for your records.
Template in the forum library. Send by signed for post.
We can use SB when we find out if they have the CCA.

Hi nem thanks for replying. They stated in their recent letter they are waiting for my credit agreement until then my account is on hold. Do I still send them a cca request ? What do u mean which of lowells trading styles lol sorry being thick. Xx

It's all Lowell financial Hun apart from one which is fidelite. I sent the original cca request years ago 7 years this year. But I sent a prove it letter about 2 weeks ago. As I got fed up of the letters and was hoping I could stall them for enough time so the default ends lol. They have also put at the bottom of my letter that they do not acknowledge or accept any of the terms conditions , fee schedules and time frames that I have set out in my correspondence. Any claims will b defended xx

It's ok for Lowlife to impose terms, conditions and timescales and failing to comply with a Statutory Time Limit is OK it seems.
I would stick a new CCA request in but this time address it to Andrew Bartle, Chief Operating Officer

Or charges for writing letters to them?
