      Yes make a point such as " after repeated requests the claimant has failed to comply with my CCA request.

        Ok thanks.

        What I don't get is there was a previous attempt at mediation and it failed because I did not get the documents. So I was surprised that the judge from my local court has said that mediation is the way forward.

          I think the admin DJ's needle got stuck, so used to finding claims suitable for mediation they can't change!

            With regard to Notice of Allocation to small claims track.

            I would like to accept the offer of Mediation.

            However may I make you aware that despite repeated requests the Claimant has failed to provide me with CCA request and documents mentioned in statement of case under CPR31.14.

                  Ok that's done. I got an auto response saying that they aim to respond in 5 days. Is it safe to assume so long as I responded within the 7 days time limit that was set, then I just wait and see what happens next?

                    The court Order/Directions you received this morning (not a "letter") posted on this thread did not order Mediation. It said that it "encouraged" mediation. They often say that.

                    You've already contacted the SCCMS and failed/refused mediation. Why are you going down that road again?

                    A hearing has been listed for 10th February 2017 at 10.30 am.

                    Witness Statements must be filed before then.

                        Should I email mediation service and say I made a mistake in yesterday's email? Or should I just leave it now and prepare witness statements?
                        I know mediation failed last time so I was confused when the letter from court recommended it again. It's so mind boggling I am really worried now about what to do.
                        I'm on my phone so forgive typos please.
                        As I said I really do appreciate feedback and advice. You guys do a great job and I am really thankful that you are there to help.

                            No you haven't made a mistake No need to email anyone.

                            You seemed to be getting worried about the Mediation when in fact the court didn't order it. As nemesis said DJs often recommend it presumably to keep court hearings to a minimum when they are so overbooked.

                            The date or timescale for filing your WS should be in those Directions. If you've still not received any documents from the Claimant then you've nothing major to worry about.

                            (I can't open the documents you uploaded in post # 130 this morning for some odd reason.)
