Without the agreement and the terms and conditions the debt is unenforceable.

Please refresh my memory did the judge order you to do anything ?

Cohen is attempting to baffle you here.
Can you post a copy of the letter please.

I have sent all the paperwork to Kati , hopefully she wont mind uploading it for me. The claim was struck out in February and then Lowell solicitors took over from Cogen and reissue the claim . I defend it , the judge allowed ghem 56 days to reply to my claim and today I received ghis in the post.
There's T&C's included along with a digital signature application , notice of default plus few pages of transactions.

Ok this is a " reconstituted " agreement which must have.

        1. Your name and address as it was when the account was opened.

        2. The original creditors name and address as it was when the account was opened.

        3. The terms and conditions relevant when the account was opened.

        4. The terms and conditions relevant when the account was closed.

        5. Any other documents mentioned in the T's & C's.

You should also have signed current statement of the account.

So check carefully and I will look at the documents once they are posted.

        Is there actually anything new?

Most of the documents were uploaded here already, what is new is the Terms and Conditions and the list of transactions. I will try to find the original uploads and will tag you in .

It's no different from what was provided previously just statements included.

I still maintain that there should be more T's & C's.

That is correct , but if you look at their response they are asking for my defence to be strike out ,
Do ai need to send a response to the court ? or shiuld I wait for a letter in the post?
Also the list of transactions that I received starts a year later from when the accoubt was opened.
Not sure what to do now😥

I'm puzzled as to why the T's & C's are for a Grattan credit card??

I 'll see what I can find out.

Was your card branded " Grattan" or one of the other brands mentioned on the T's & C's?
