    cheers il use the template i found here and ammend to my needs, even the time extension was a pain to sort out with them lol. Now the question is there anything i should send to MC or just leave it after i file my defence and is it ok after ive wrote it for you to check it out for me

      Yes please post it up once you've got a draft together.

      You will likely have to file via Email or on Paper, in which case yes you should send a copy to MC. If Moneyclaimonline is still unbarred ( actually might be an idea to check that now ref this defence bit) then there's no need to send them a copy as the court do that.

        Imho I wouldn't contact the solicitors by phone, though.

        Everything in writing, either e-mail or land mail with proof of posting.

                UPDATE

                on the 04/02/16 i received a letter from mortimer clarke saying they had received my defence which is strange as i did not send it till the 12/02/16. I then received another dated 07/03/16 saying the same thing (i will attach letters at the end of the post ). Today i have eventually received a letter from cabot thanking me for my request of information. I am just wondering what if any my next step would be any help would be appreciated

                    If you entered your defence on the 12th ( and it looks fine btw - couple little bits where you've left templated bits in but nothing fatal ) then you should contact the court about the 15th Apr to see if the claimants have indicated they wish to proceed. It is most likely the claim will be stayed at that point until they either find the documents or discontinue.

                      UPDATE : rang today and the claim has been stayed. Is there anything else i need to do or do i just wait and see what happens ?

                          Really it's wait and see what happens, you could apply to the court to have the claim struck out for the lack of documents/evidence but this will carry a cost of at least £100, most likely £255. You could write to them now and suggest you will be making an application and ask them to discontinue the claim to save costs ( as if you succeed in the strike application they would be liable to pay your cost of the app ) bring up the 23rd March letter - and give them a deadline of say 14 days to produce docs and apply to lift stay and proceed or bog off.
