    Hi All
    After sitting all of Sunday preparing my witness statement and posting it Monday I've just received a Notice of Discontinuance letter which they say has been filed with the court - YAY
    I would just like to thank everyone on the site especially Nem, Amethyst and FlamingParrot for all the help and advice they have given I really couldn't have done it without you guys. One final question though do I need to do anything else now

      Well done APH a great result, all you need to do now is check with the court that The discontinuance has be notified.

                Hi guys....me again !!
                Sorry but I need to asked for your help again on a couple of things, thankfully I am the chaser not the chased.
                Firstly can two debt collection agents register the same debt with the land registry ?
                The reason I ask is that several years ago when we had financial difficulties with our business Mortimer Clark & Restons solicitors both put a charge against our house which were paid on the completion of the sale.
                Just recently I noted on the "paid out" list that our solicitor gave us there is two listings for HFC bank both are very similar amounts. I have been I touch with HFC and they have confirmed that we only ever held one account. We have written to Mortimer Clark & Restons asking them to provide details of the debts that have been paid to them but surprise surprise we have had no reply.

                Secondly many years ago I had a mortgage with Skipton Building Society they have confirmed that there was mortgage protection on this but have basically said its not their problem as the mortgage was done via a broker at the estate agents ?

                Sorry if it's a bit of a jumble and I'm not sure I shouldn't have started new threads but any help / advice would be appreciated.

                  Only one charge can be recorded for one debt, not two, and they can't be debt collectors, they would be debt purchasers who own the account, collection agent's can't get charges.

                  Were there two payments made from the proceeds of the sale or just one? Both Mortimer Clark and Restons would have been acting for the same creditor so they couldn't record a charge each. Have you checked with the solicitor or conveyancer that dealt with the sale of the house?

                  It was customary to get a broker at the estate agents to arrange your mortgage and also insurance, with the insurance being totally separate from the mortgage. For example I had the mortgage with the now defunct Bradford & Bingley and the insurance with General Accident (now Aviva, pretty much alive and kicking), both arranged trough the broker at the estate agents. You'll need to look at who the insurance was with.

                  It would be best if you started new threads for each issue so we don't end up getting confused as we are dealing with three separate matters here: the claim from Lowell which is more time-sensitive, the HFC charges and a potential insurance reclaim which would go under the PPI section. :thumb:
