    I received a letter from the court stating they would let me know which track the claim would be allocated to but that was over a month ago and I still haven't had notification is this common for them to take so long ? Oh and still no documents from Lowell / BW

          Good morning APH,

          Sorry I missed your post yesterday!

          This is a delay longer than usual at this stag, so a quick call to the court office ( after 1000hrs) and ask about the status of the claim.

          If Lowell hasn't complied with the CCA request within the 12 + 2 Working Days time scale the debt is unenforceable until the agreement is produced.

              Well I spoke to soon !
              i didn't manage to get hold of the court to ask about status of the claim and received a letter this morning saying it had been allocated to small claims and a date set for September.
              The claimant has been informed that in order for the hearing to take place they need to pay a fee of £335 by the 4 June this is probably more than they paid for the debt working on 10%. Just wondered what your thoughts were on that ?
              Also if they don't pay the fee will the court let me know or do I have to contact them after 4 June .
              Any advice is always welcome

                There is a possibility the cost outweigh the merits of the claim so unless they
                are totally confident of winning they may withdraw.
                Contact the court 24 hours after 4June to see if the fee has been paid.
                IF it has been paid the claim continues in the normal process.

                  Thanks for getting back to me so quickly.
                  I'll do that on 5th and I don't want to tempt fate but hopefully it won't make financial sense for them to pursue.
                  When I ring the court on 5th and if they haven't paid for the hearing is that the point I pay £155 to have the claim struck off.
                  If this happens I assume they wouldn't be able to bring a claim against me even if the documents turn up at a later date ?

                    Could you shed any light on this for me as I find it really quite odd.
                    I received two letters on Saturday from RBS both saying the same and with two cheques attached both for £50.
                    The letters basically say after passing the debt to J & J Collections in 2005 they were sorry for any inconvenience and distress this may have caused and after checking with Lowell who confirmed the account was still live they enclosed cheques were compensation !!!
                    Like I said I find it all very odd being so close to the time Lowell have to pay the £300 ish on 4th June for the hearing to go ahead. I think I should just send them back otherwise I'm admitting liability. Oh and the other thing that puzzles me how does RBS know it's been passed to Lowell as it went to numerous companies before them.

                      You are not the only one receiving compensation, I posted on another thread a few days ago where £50 had been credited to an old account that had been passed on to Lowell and the credit was related to something that took place in 2008! I'll try to find the thread in question.

                      I've not read the whole of your thread above so I'm not sure if your account is meant to be statute barred. If it was already SBd at the time the claim was issued, nothing can un-bar it, not even if you were to make a payment into the account. Furthermore, any payments have to be made by yourself or someone acting for you, for example, a DMP provider or debt advisor. Refunds from creditors do not count, otherwise every creditor would be making small payments into their own accounts to keep them alive.
