    I clearly wouldn't know a DN if it came up and slapped me..... I've now emailed the default notice. It too has a/c no 11 0319 2376

      Okay, thanks got the default notice now lol. All looks compliant I'm afraid.

      The acc number is really going to be deminimus - the assignment and DN etc are same acc - only the claim is a different one and that will be explained as a typo and fixed easily.

        Sorry Holly, I'm of the opinion you'd be best off negotiating a Tomlin Order with the Claimants for an installment amount - to keep you away from a CCJ and more damage to your credit file - and keep the bank some securiity of if you miss payments they can then enforce the judgment.

          The assignment and the default are actually different numbers. But I get your drift. How do I go about putting a Tomlin order in place and what are the chances of success?

            If that DN is kosher then I don't see a decent argument here I'm afraid. If the numbers for the accounts were radically different and stated different amounts, then you could reasonably argue that the claim was flawed, but if all you have is typo or similar on different documents, then I can't see any judge dismissing this as a claim for the wrong account.

            You've fought this well and we've tried everything, but as the odds are so stacked against you it is probably better to bite the bullet.

              Okay - so onwards and upwards.

              how do I go about negotiating a Tomlin order?

              can I use their mix up of the account numbers to my advantage?

              do you typically look to reduce the amount and pay by instalments?

              Any advice would be really appreciated.
