      Amendments to statements of case

      17.1
      (1) A party may amend his statement of case at any time before it has been served on any other party.
      (2) If his statement of case has been served, a party may amend it only –
      (a) with the written consent of all the other parties; or
      (b) with the permission of the court.
      (3) If a statement of case has been served, an application to amend it by removing, adding or substituting a party must be made in accordance with rule 19.4.
      (Part 22 requires amendments to a statement of case to be verified by a statement of truth unless the court orders otherwise)
      thats the most important part of rule 17

        ok thank you, 1st credit know have a copy of the ammended statment, if they do not contact me by 9th of May i wil suppmit the file to the court. Does that sound ok?

              Sorry I didn't explain the last post very good, yes they have agreed to the amended defence. They also requested that they have a copy of the amended defence and witness statement by the 1st of May before I submit to the court, which I have. When do I submit my amended defence to the court and do I contact 1st credit as I have had no communication with them.

                  If 1st Credit have agreed the amended Defence then you send the defence to the Court along with a letter covering the fact that 1st credit have agreed pursuant to CPR rule 17 etc as set out above, and for belt and braces send a copy of the letter from 1st credit confirming their consent to the defence

                        hi all
                        Received 1st credits file for trial on the 6th of June, they are refusing to accept the debt is statute barred, even though they havnt supply any information to support it.
                        They state the ppi wasnt missold even though i ticked the no box on the credit agreement.
                        Will the judge get chace to look through my defence file prioe to the hearing? Any advice for when i get to court please, feeling really nervouse.

                            What have 1st Credit said in order to dispute the debt was statute barred or are they still sticking to the paid through a DMP thing?

                                Sorry missed this bit, no mention of a dmp, just a screen print out with the payments made, mo acount numbers, name or method of payment.
